An additional note of caution was again raised with respect to the wording of the draft article that could be seen to suggest that the act or omission of the carrier could result in the liability of the performing party.

Second, under the Italian proposal, the instrument would create a cause of action by the cargo owner against the performing party on the terms of the contract between the performing party and the carrier.
