127- وعلى أصحاب المطالبات المتعلقة بالخسائر في دخل المؤسسات أن يثبتوا أيضاً أن المؤسسة كانت تحقق أرباحاً أو كان من المتوقع، بصورة معقولة، أن تحقق أرباحاً خلال فترة الخسارة.

The general principles outlined by the " E2 " and " E4 " Panels on the period of loss issue may be summarized as follows:
133- ويمكن إيجاز المبادئ العامة التي عرضها الفريقان المعنيان بالمطالبات من الفئتين " هاء/2 " و " هاء/4 " بشأن فترة الخسارة كما يلي:

The Panel is also mindful of the large numbers of category " D " claims for loss of business income, and the resulting difficulty of doing a case by case assessment of the period of loss for businesses in and outside of the affected region.
134- ويضع الفريق في اعتباره أيضاً الأعداد الكبيرة للمطالبات من الفئة " دال " المتعلقة بالخسائر في دخل المؤسسات، وما يترتب على ذلك من صعوبة في تقييم فترة الخسارة للمؤسسات داخل المنطقة المتأثرة وخارجها على أساس كل حالة على حدة.

The Panel also notes that the period of loss forming the basis of an award cannot, in any circumstance, exceed that advanced by the claimant.
136- ويلاحظ الفريق أيضاً أن فترة الخسارة التي تشكل أساس التعويض الممنوح لا يمكن، بأي حال من الأحوال، أن تتجاوز الفترة التي يدعيها صاحب المطالبة.

For rent-a-permit claims, the Panel applies the same legal analysis for the determination of the period of loss as in the case of loss of business income claims.

In respect of claims arising from the delay in the receipt of insurance payments from an insurer for goods that were delivered to a Kuwaiti buyer but were not paid for, or that were lost or destroyed in transit, the Panel determines that the period of loss should start from 2 August 1990 or the due date of the expected payment, if later.
