(a) If the Pre-Trial Chamber decides to let a person remain free, or to release a person, the Pre-Trial Chamber may set one or more conditions, including the following: This is a non-exhaustive list.
)أ( إذا قررت الدائرة التمهيدية اﻹفراج عن شخص جاز لها اخضاع هذا اﻹفراج لشرط أو أكثر وبخاصة للشروط الواردة أدناه)٩(:

1. Whenever the Pre-Trial Chamber decides to designate a single judge in accordance with article 39, paragraph 2 (b) (iii), it shall do so on the basis of objective pre-established criteria.

3. If the Pre-Trial Chamber decides not to hold a hearing on confirmation of charges in the absence of the person concerned, and the person is not available to the Court, the confirmation of charges may not take place until the person is available to the Court.
3 - إذا قررت الدائرة التمهيدية عدم عقد جلسة إقرار التهم في غياب الشخص المعني، ولم يكن هذا الشخص موجودا تحت تصرف المحكمة، فإن إقرار التهم لا يمكن أن يتم ما دام هذا الشخص غير موجود تحت تصرف المحكمة.

4. If the Pre-Trial Chamber decides not to hold a hearing on confirmation of charges in the absence of the person concerned, and the person is available to the Court, it shall order the person to appear.
4 - إذا قررت الدائرة التمهيدية عدم عقد جلسة إقرار التهم في غياب الشخص المعني وكان هذا الشخص موجودا تحت تصرف المحكمة، فإنها تأمر بمثوله أمامها.

(b) If the Pre-Trial Chamber decides not to hold a hearing on confirmation of charges in the absence of the person concerned, and the person is not available to the Court, the confirmation of the charges may not take place until the person is available to the Court.
)ب( إذا قررت الدائرة التمهيدية عدم عقد هذه الجلسة في غياب الشخص المعني ولم يكن هذا الشخص موجودا تحت تصرف المحكمة، فإن إقرار التُهم لا يمكن أن يتم ما دام هذا الشخص غير موجود تحت تصرف المحكمة.

(a) If the Pre-Trial Chamber decides to hold a hearing on confirmation of charges in the absence of the person concerned, the provisions of rule 5.9 See document PCNICC/1999/WGRPE/RT.3.
)أ( إذا قررت الدائرة التمهيدية عقد جلسة ﻹقرار التُهم في غياب الشخص المعني، فإن أحكام القاعدة ٥-٩ تنطبق، مع التعديل اللازم، على اﻹعداد لهذه الجلسة)٣(.

(b) If the Pre-Trial Chamber decides not to hold a hearing on confirmation of charges in the absence of the person concerned, and the person is not available to the Court, the confirmation of charges may not take place until the person is available to the Court.
