Some delegations expressed the view that the inclusion within the preliminary draft protocol of an appropriate safeguard clause recognizing the primacy of the existing principles of international space law would be necessary in order to ensure that the principles were in no way compromised.
153- وأعربت بعض الوفود عن رأي مفاده أن تضمين المشروع الأولي للبروتوكول شرطا ضمانيا ملائما يسلّم بأولية مبادئ قانون الفضاء الدولي الراهنة سيكون ضروريا لضمان عدم المساس بأي شكل من الأشكال بتلك المبادئ.

The view was expressed that it would be premature to address the issue of the primacy of existing international space law principles until the text of the preliminary draft protocol was finalized.
154- أبدي رأي مفاده أنه سيكون من السابق لأوانه معالجة مسألة أولية مبادئ قانون الفضاء الدولي الراهنة إلى أن توضع الصيغة النهائية لنص المشروع الأولي للبروتوكول.

Therefore that delegation favoured retaining the item on the agenda of the Legal Subcommittee for its forty-second session, in 2003, and, more generally, until the preliminary draft protocol had been fully developed and finalized.

104- وأبدت بعض الوفود رأيها بأنه ينبغي النظر في تعديل المشروع الأولي للبروتوكول بحيث لا يجوز إجراء أي نقل إلى دائنين موجودين في ولاية قضائية مختلفة دون موافقة السلطة الحكومية المختصة المعنية.

13. It was noted that the Legal Subcommittee should consider whether or not to retain the subject of the preliminary draft protocol on matters specific to space assets on its agenda beyond 2002.
13- وأشير الى ضرورة أن تنظر اللجنة الفرعية القانونية فيما إذا كانت ستبقي على موضوع المشروع الأولي للبروتوكول المتعلق بالمسائل الخاصة بالموجودات الفضائية على جداول أعمالها لما بعد عام 2002 أم لا.

Some delegations reiterated the view that a number of substantive issues relating to the Convention on International Interests in Mobile Equipment and the preliminary draft protocol required further consideration, taking into full account the rights and obligations of States under the existing international space treaties.
159- كررت بعض الوفود الاعراب عن رأي مفاده أن عددا من المسائل المضمونية المتعلقة باتفاقية الضمانات الدولية على المعدات المنقولة والمشروع الأولي للبروتوكول تتطلب المزيد من النظر، مع أخذ حقوق الدول والتزاماتها بموجب المعاهدات الدولية الراهنة المتعلقة بالفضاء في كامل الاعتبار.

The view was expressed that the definition of space assets in the preliminary draft protocol was broad and ambiguous and that the protocol should include a list of specific space assets to which it applied, as had been done for aircraft equipment under the Aircraft Protocol.
129- وأُعرب عن رأي بأن تعريف الموجودات الفضائية في مشروع البروتوكول الأولي واسع وغامض، وأنه ينبغي أن يتضمن البروتوكول قائمة بالموجودات الفضائية المحددة التي يُطبّق عليها، مثلما تم بالنسبة إلى بروتوكول معدات الطائرات.

Some delegations reiterated the view that the Convention and the preliminary draft protocol should neither undermine nor compromise existing principles of international space law and that, in case of a conflict, the latter principles should prevail.
152- كررت بعض الوفود الاعراب عن الرأي الذي مفاده أنه لا ينبغي للاتفاقية ولا للمشروع الأولي للبروتوكول أن يعطّلا ولا أن يضعفا مبادئ قانون الفضاء الدولي الراهنة وأن الغلبة ينبغي أن تكون لهذه الأخيرة في حال حصول تنازع.
