Thus, the present article does not address the question of the definition of aggression by a State, which is beyond the scope of the present Code.

Any party shall have the right to designate information or parts of it as confidential, except as otherwise provided in paragraphs 2 and 3 above, and request that its confidentiality be protected in accordance with the present Code.

At the same time, however, article 1, paragraph 4, of the Criminal Procedure Code provides that " International treaties of the Republic of Belarus that define rights and freedoms of individuals and citizens shall apply in criminal proceedings along with the present Code " .

That restrictive approach could be seen in article 1 of the draft Code, which provided that " the present Code applies to the crimes against the peace and security of mankind set out in Part II " .

(a) The adoption of Act No. 200207 on the Personal and Family Code of 24 August 2004, which prohibits polygamy, sets the marriageable age at 18 for men and women and provides, in article 1030, that " custom ceases to have the force of law in all matters covered by the present Code " ;
(أ) اعتماد القانون رقم 2002/7 المؤرخ 24 آب/أغسطس 2004 المتعلق بمدونة قانون الأشخاص والأسرة والذي يحظر تعدد الزوجات ويحدد سن الزواج بثمانية عشر عاماً للرجال والنساء، وينص في المادة 1030 على " أن الأعراف لم تعُد لها قوة القانون فيما يتعلق بجميع المسائل التي تنظمها هذه المدونة " ؛

1. The provisions of the present Code complement those of the Regulations Governing the Status, Basic Rights and Duties of Officials other than Secretariat Officials, and Experts on Mission (ST/SGB/2002/9) (hereinafter referred to as " the Regulations " );
1- تتكامل أحكام هذه المدونة تكاملاً متبادلاً مع أحكام النظام الأساسي الذي ينظم مركز المسؤولين بخلاف موظفي الأمانة العامة والخبراء القائمين بمهمة وحقوقهم وواجباتهم الأساسية (ST/SGB/2002/9) (يشار إليه فيما يلي بعبارة " النظام الأساسي " )؛

Mandate-holders may resort to urgent appeals in cases where the alleged violations are time-sensitive in terms of involving loss of life, life-threatening situations or either imminent or ongoing damage of a very grave nature to victims that cannot be addressed in a timely manner by the procedure under article 9 of the present Code.
يجوز لأصحاب الولايات أن يلجأوا إلى توجيه نداءات عاجلة في حالات الانتهاكات المزعومة التي يكون فيها عامل الوقت حاسماً لأنها تنطوي على الوفاة أو تشكل خطراً على الحياة، أو تنطوي على إلحاق ضرر بضحايا يكون ضرراً وشيكاً أو قائماً ذا طابع خطير للغاية ولا يمكن معالجته في وقت مناسب بالإجراء المنصوص عليه في المادة 9 من هذه المدونة.

Consequently, the provisions of article 9 (The exercise of the treaty-making power) in the introduction to the present Code (A/CN.4/101) apply mutatis mutandis to the process of termination and withdrawal in the same way as they do to that of the making and conclusion of treaties.
وبناء عليه، فإن أحكام المادة 9 (ممارسة سلطة وضع المعاهدات) الواردة في مقدمة هذه المدونة (A/CN.4/101) تسري مع مراعاة ما يقتضيه اختلاف الحال على عملية الإنهاء والانسحاب بنفس الطريقة التي تسري بها على عملية وضع المعاهدات وإبرامها.
