المادة ٤-٢ )ﻫ(: متى كانت الوقائع موضوع الرسالــة قــد حدثــت قبل بدء نفاذ هذا البروتوكول بالنسبة للدولة الطرف المعنية، إلا إذا استمرت تلــك الوقائــع بعد تاريخ النفاذ.

8.4 In accordance with article 4, paragraph 2 (e), of the Optional Protocol, the Committee shall declare a communication inadmissible where the facts that are the subject of the communication occurred prior to the entry into force of the present Protocol for the State Party concerned unless those facts continued after that date.
8-4 وتنص الفقرة 2 (هـ) من المادة 4، على أن اللجنة تعلن عدم مقبولية بلاغ ما عندما تكون الوقائع موضوع البلاغ قد حدثت قبل بدء سريان مفعول البروتوكول الحالي بالنسبة للدولة الطرف المعنية، إلا إذا استمرت تلك الوقائع بعد ذلك التاريخ.

(b) The facts that are the subject of the communication occurred prior to the entry into force of the present Protocol for the State Party concerned unless the facts can be shown to amount to a violation of the Covenant after that date;
(ب) متى كانت الوقائع موضوع البلاغ قد حدثت قبل بدء نفاذ هذا البروتوكول بالنسبة للدولة الطرف المعنية، إلا إذا أمكن تبيان أن الوقائع تشكل انتهاكاً للعهد بعد تاريخ بدء النفاذ؛

(b) The facts that are the subject of the communication occurred prior to the entry into force of the present Protocol for the State Party concerned unless the those facts continued can be shown to amount to a violation of the Covenant after that date;
(ب) متى كانت الوقائع موضوع البلاغ قد حدثت قبل بدء نفاذ هذا البروتوكول بالنسبة للدولة الطرف المعنية، إلا إذا أمكن تبيان أن استمرت هذه الوقائع تشكل انتهاكاً للعهد بعد تاريخ بدء النفاذ؛

(و) أو متى كانت الوقائع موضوع البلاغ قد حدثت قبل بدء نفاذ هذا البروتوكول بالنسبة للدولة الطرف المعنية، إلا إذا استمرت تلك الوقائع بعد تاريخ النفاذ.
