3- إذا لم يعين رئيس هيئة التحكيم في غضون مهلة الشهرين التي تلي تعيين المحكم الثاني، يقوم الأمين التنفيذي للجنة الاقتصادية لأوروبا، بناء على طلب أحد طرفي النـزاع، بتعيينه في غضون مهلة شهرين جديدة.

5- إذا لم تتفق الأطراف على موضوع النزاع قبل تسمية رئيس هيئة التحكيم القضائية، تقوم هيئة التحكيم القضائية بتحديد الموضوع.
