The Government explained that the sentence, issued in connection with the article which was said to have harmed relations between the Kingdom of Saudi Arabia and Yemen, was in accordance with the provision of article 106 (a) of the Press and Publications Act.

150. Article 25 of the Press and Publications Act of 2009 provides for the rights and immunities guaranteed to journalists by law. It reads as follows: " (1) Journalists enjoy the following rights and immunities:
150- نصت المادة 25 من قانون الصحافة والمطبوعات الصحفية لسنة 2009 على الحقوق والحصانات التي كفلها القانون للصحفي، ويقرأ نصها كالآتي: -25(1) " يتمتع الصحافي بالحقوق والحصانات الآتية:

Article 103 of the Press and Publications Act No. 25 of 1990 stipulates that: " It shall be forbidden to publish and broadcast anything which foments tribal, factional, racial, regional or family arrogance or pride and to spread dissension and division among the individuals of society or anything which calls for their stigmatisation as heretics or which incites the use of violence and intimidation. "
129- نصت المادة 103 من قانون الصحافة والمطبوعات رقم 25 لسنة 1990 على: " حظر نشر وإذاعة ما يؤدي إلى إثارة النعرات القبلية أو الطائفية أو العنصرية أو المناطقية أو السلالية وبث روح الشقاق والتفرقة بين أفراد المجتمع أو ما يدعو إلى تكفيرهم أو التحريض على استخدام العنف والإرهاب " .

قانون الصحافة والمطبوعات رقم (25) لعام 1990م : (يمنح الصحفي الحق في نشر أفكاره وآرائه والحق في عدم ذكر مصادر معلوماته وفقاً للإجراءات والحدود المنصوص عليها إلى جانب حقه في الحصول على المعلومات والحق في مد الصحفي بالمعلومات وتنظيم عمله).

It also prohibits the administrative closure of newspapers by the Council for more than two days and the imprisonment of journalists for acts that have nothing to do with the public interest, such as defamation, which carries a fine (the Press and Publications Act of 2009 is attached, in English).
كما منع القانون الإيقاف الإداري للصحف بواسطة المجلس إلا لمدة يومين، ومنع توقيع عقوبة السجن على الصحفيين على الأفعال التي لا تتعلق بالمصلحة العامة كجرائم القذف وتشويه السمعة والاستعاضة عنها بفرض غرامة (مرفق قانون الصحافة والمطبوعات 2009 باللغة الإنكليزية).

151. A key right provided for in the Press and Publications Act of 2009 is the right to a hearing and a defence. Article 33 (2) provides as follows: " Before imposing any sanction on a person, the Council must accord to him the right to be heard and to defend himself. "
151- ومن أهم الحقوق التي نص عليها قانون الصحافة والمطبوعات الصحفية لسنة 2009، حق السماع والدفاع فالمادة 33(2) نصت على الآتي " يجب على المجلس قبل توقيع أي جزاء في حق أي شخص أن يتيح له حق السماع والدفاع عن نفسه " .

50. Article19 noted that under the Press and Publications Act 1991, journalists were obliged to obtain government registration, which resulted in a system open to abuse. Regulation of broadcasting was also controlled by the Ministry of Information and Communication, rather than by an independent body.
50- وأشارت منظمة " المادة 19 " إلى أن قانون الصحافة والمنشورات لعام 1991 يُلزم الصحفيين بالحصول على تصريح حكومي، مما يفسح المجال أمام حدوث تجاوزات(119).كما تتولى وزارة المعلومات والاتصال تنظيم أنشطة الإذاعة بدلاً من إسنادها إلى هيئة مستقلة(120).

On 17 July 2001, the Press and Publications Act was promulgated by Royal Decree No. M/32 of 30/9/1421 AH to provide greater scope for freedom of expression.
