وتشير اللجنة إلى أنه في حالات الاختفاء القسري فإن الحرمان من الحرية المتبوع برفض الاعتراف بهذا الحرمان أو بإخفاء مصير الشخص المفقود يحرم الشخص من الحماية التي يوفرها له القانون ويُعرض حياته لخطر كبير ودائم تكون الدولة هي الجهة التي تُساءل عنه.

The Committee recalls that, in cases of enforced disappearance, the deprivation of liberty, followed by a refusal to acknowledge that fact or by concealment of the fate or whereabouts of the disappeared persons, removes such persons from the protection of the law and places their lives at serious and constant risk, for which the State is accountable.
وتشير الآراء بوضوح إلى أن " اللجنة تذكّر، فيما يتعلق بالاختفاء القسري، بأن الحرمان من الحرية ثم عدم الإقرار بذلك، أو عدم الكشف عن مصير الشخص المختفي أو مكان وجوده، يحرم هذا الشخص من حماية القانون له ويعرّض حياته لخطر جسيم ودائم تتحمل الدولة مسؤوليته.
