وتنص المادة 41 على تصنيف الرشوة كجريمة جنائية حتى إن لم يقبل الموظف العام الرشوة.

42. In addition, State Administration Act No. 18.575 lays down that: " The State shall be responsible for injury caused by the organs of the Administration in the exercise of their functions, without prejudice to the possible responsibilities of the public official who caused such injury. "
٢٤- وينص أيضاً قانون إدارة الدولة رقم ٥٧٥٨١ على ما يلي: " الدولة مسؤولة عن الضرر الذي تسببه أجهزتها اﻹدارية لدى ممارستها ﻷعمالها، دون اﻹخلال بالمسؤولية المحتملة للموظف العام الذي يتسبب في هذا الضرر " .

However, the concept of an undue advantage for a person or entity other than the public official is not addressed.
غير أنّه لم يجرِ تناول مفهوم الميزة غير المستحقة لشخص أو كيان آخر غير الموظف العمومي.

In one of the concerned jurisdictions, for example, the offence was only constituted where property was diverted to a person other than the public official himself.
فمثلا في إحدى الولايات القضائية المعنية كان الفعل الإجرامي لا يشكل جريمة إلاَّ حيث تحوَّل الممتلكات إلى شخص غير الموظف العمومي نفسه.

In another State party the offence was deemed to have been committed irrespective of any resulting damage to the public office or any benefit or enrichment for the public official.
وفي دولة طرف أخرى كانت الجريمة تُعتبر قد ارتُكبت بصرف النظر عن أيِّ ضرر ناجم عنها يقع على الوظيفة العمومية أو أيِّ منفعة تعود على الموظف العمومي أو إثراء يعود عليه.

Where the undue remuneration was a result of the public official delaying, failing to fulfil or acting contrary to their duties, the said official is penalized for aggravated bribery.
وحيثما كان الأجر غير المستحق نتيجةً لتأخير الموظف العمومي في أداء واجباته أو عدم أدائها أو إتيان فعل مناف لتلك الواجبات، يُعاقَب الموظف المعني على جُرم الارتشاء المشدِّد للعقوبة.

In a more specific context, section 39 of the State Civil Service Law provides for the suspension from the performance of duties where detention has been applied as a security measure or criminal prosecution has been initiated against the public official.
وفي سياق أكثر تحديداً، تنصُّ المادة 39 من قانون الخدمة المدنية على صعيد الدولة على إيقاف الموظف العمومي عن العمل في حال احتجازه كإجراء أمني أو الشروع في ملاحقته جنائيًّا.

The difference between article 259 and articles 256 and 257 is that the latter two require that the public official or the magistrate make a corrupt commitment to perform, delay or refrain from performing an act relating to their duties.
والفارق ما بين المادة 259 والمادتين 256 و257 أنَّ المادتين الأخيرتين تقتضيان قيام الموظف العمومي أو القاضي بتقديم تعهد فاسد بأن يؤدي عملا أو يعطل عملا أو يمتنع عن أداء عمل ممّا له صلة بوظيفته.

On the other hand, article 259 does not require any action in exchange for the gift, which is only being offered due to the position of the public official.
وفي المقابل، فإنَّ المادة 259 لا تقتضي القيام بأيِّ عمل مقابلَ الهدية، التي تُعرض لا لأيِّ داع إلاَّ منصب الموظف العمومي.

Nevertheless, with regard to bribing of a public official, in contrast to the article on bribery by a public official, it is not specified that the beneficiary may be a person or entity other than the public official.
إلاّ أنَّه خلافاً للمادة المتعلقة بارتشاء الموظف العمومي، لا يرد نصٌ، فيما يتعلق برشو الموظف العمومي، على أنّ المستفيد قد يكون شخصاً أو كياناً آخر غير الموظف العمومي.

Article 4 also establishes a presumption, where it is proved that the public official solicited, accepted or obtained a gratification, that the gratification was obtained in connection with a bribery offence, unless proven to the contrary.
وتضع المادة 4 أيضاً افتراضاً مفاده أنّه عندما يَثبت أنّ الموظف العمومي التمس مكافأة أو قبِلها أو حصل عليها، يكون الحصول على المكافأة متصلاً بجريمة رشوة، ما لم يَثبت خلاف ذلك.

In another case, the legislation did not mention the purpose of obtaining an undue advantage for the public official or for another person or entity, though the accrual of benefits to third persons was considered to have been indirectly covered.
وفي حالة أخرى، لم يتطرق التشريع إلى ارتكاب الفعل بقصد الحصول على مزية غير مستحقة لصالح موظف عمومي أو شخص آخر أو كيان ما، ولكن تحقيق المنافع للأطراف الثالثة اعتبر مشمولا فيه بشكل غير مباشر.

In both articles 424 and 423 CC, an element of the established offences is the performance and non-performance by the public official of an " official or other act " .
وفي كل من المادتين 424 و423 من القانون الجنائي يعد أداء موظف عمومي أو عدم أدائه " لفعل رسمي أو غيره " عنصراً من عناصر الفعل المجرَّم.

41. Accordingly, article 38 (2) of the Constitution, referring to the General Principles of State Administration, stipulates that: " Any person whose rights are infringed by the State Administration, its agencies or the municipal authorities, may lodge a complaint with the courts provided for by the law, without prejudice to the possible responsibility of the public official who caused those rights to be infringed. "
١٤- وتنص بناء على ذلك الفقرة ٢ من المادة ٨٣ من الدستور المتعلقة بالمبادئ العامة ﻹدارة الدولة على ما يلي: " لكل من انتهكت إدارة الدولة أو وكالاتها أو سلطاتها المحلية حقاً من حقوقه اﻷساسية الحق في اللجوء إلى المحاكم التي ينص عليها القانون، دون اﻹخلال بالمسؤولية المحتملة للموظف العام الذي يتسبب في انتهاك هذا الحق " .

The fundamental duty of the public official was to commit him/herself to the public good, regardless of whether the official was from the legislative, executive or judicial branch of Government.
والواجب الأساسي الذي يقع على عاتق المسؤول العام هو الالتزام بتحقيق المنفعة العامة، بغض النظر عن انتسابه للسلطة التشريعية أو التنفيذية أو القضائية للحكومة.
