24. The situation of the relying party is a peculiar one, because it is unlikely that either the signatory or the certification services provider could be damaged by an act or omission of the relying party.
24- وأما الحال بالنسبة إلى الطرف المعوّل فهي حال مخصوصة، لأنه ليس من المرجّح أن يتضرّر الموقّع ولا مقدّم خدمات التصديق من جراء فعل أو امتناع عن فعل من جانب الطرف المعوّل.

In most circumstances, if the relying party fails to exercise the requisite degree of care, he or she would bear the consequences of his or her actions, but would not incur any liability towards the certification services provider.

In this situation, there are two injured parties: the relying party who was defrauded by the erroneously issued certificate, and the person whose identity was impersonated in the erroneously issued certificate.

It is not intended to deal with the issue of the validity of an electronic signature, which is addressed under article 6 and should not depend upon the conduct of the relying party.
وليس مقصودا منها أن تتناول مسألة صحة التوقيع الالكتروني، التي يجري تناولها في اطار المادة 6 والتي لا ينبغي أن تتوقف على سلوك الطرف المعول.

The requirements of article 11 are not intended to require the observation of limitations, or verification of information, not readily accessible to the relying party.
ولا يقصد من اشتراطات المادة 11 أن تشترط مراعاة القيود، أو التحقق من العلومات، التي لا يسهل على الطرف المعول الوصول اليها.

Another suggestion was that a general statement should be inserted in the paragraph along the following lines: " The consequences of failure by the relying party to comply with the requirements of article 11 are governed by the law applicable outside the Model Law. "

إذ إن الطرف المعوِّل يقرّر ما إذا كان سيقبل بالشهادة الأجنبية استنادا إلى ما إذا كانت الشهادة صادرة عن مقدّم خدمات تصديق أجنبي جدير بالثقة.
