٤١ - لا يجوز للدولة الطرف الطالبة أن تنقل المعلومات أو اﻷدلة التي زودها بها الطرف متلقي الطلب أو أن تستخدمها في تحقيقات أو ملاحقات أو إجراءات غير تلك المذكورة في الطلب ، دون موافقة مسبقة من الطرف متلقي الطلب .

D. Assistance may be provided whether or not the conduct underlying a request would constitute a violation of the antitrust laws of the requested Party.
هاء - يجوز تقديم المساعدة سواء كان السلوك الذي يقف وراء الطلب يشكل أو لا يشكل انتهاكاً لقوانين مكافحة الاحتكار لدى الطرف المتلقي للطلب.

The carrier and the shipper shall respond to requests from each other to provide information and instructions required for the proper handling and carriage of the goods if the information is in the requested Party's possession or the instructions are within the requested Party's reasonable ability to provide and they are not otherwise reasonably available to the requesting party.
يستجيب كل من الناقل والشاحن لما يقدّمه أحدهما إلى الآخر من طلبات لتوفير المعلومات والتعليمات اللازمة لمناولة البضاعة ونقلها بصورة ملائمة، إذا كانت المعلومات موجودة في حوزة الطرف متلقي الطلب أو كان الطرف متلقي الطلب قادرا على توفير التعليمات ضمن الحدود المعقولة، ولم تكن تلك المعلومات أو التعليمات متاحة في حدود المعقول للطرف الطالب من مصدر آخر.

If the requested Party cannot comply with the requirement of confidentiality, it shall promptly inform the requesting Party.

14. The requesting State Party shall not transmit nor use information or evidence furnished by the requested Party for investigations, prosecutions or proceedings other than those stated in the request without the prior consent of the requested Party. One delegation proposed that the use of evidence be restricted only when the requested State so indicated.
٤١ - لا يجوز للدولة الطرف الطالبة أن تنقل المعلومات أو اﻷدلة التي زودها بها الطرف متلقي الطلب أو أن تستخدمها في تحقيقات أو ملاحقات أو إجراءات غير تلك المذكورة في الطلب ، دون موافقة مسبقة من الطرف متلقي الطلب .اقترح أحد الوفود عدم تقييد استخدام اﻷدلة الا عندما تبين ذلك الدولة متلقية الطلب .

A. A person requested to testify and produce documents, records, or other articles pursuant to this Agreement may be compelled to appear and testify and produce such documents, records, and other articles, in accordance with the requirements of the laws of the requested Party.
ألف- يجوز إجبار شخص طُلب إليه الإدلاء بشهادته وتقديم مستندات أو سجلات أو مواد أخرى بموجب هذا الاتفاق على الحضور والإدلاء بالشهادة وتقديم هذه المستندات والسجلات والمواد الأخرى، وفقاً للاشتراطات المنصوص عليها في قوانين الطرف المتلقي للطلب.

Extradition shall not be granted if the requested Party has substantial grounds for believing that a request for extradition has been made for the purpose of prosecuting or punishing a person on account of his race, religion, nationality or political opinion, or that a person's position may be prejudiced for any of these reasons.
٢ - لا يوافق على التسليم إذا كان لدى الطرف المطالب أسباب جوهرية تدعو للاعتقاد بأن طلب التسليم قدم بغرض محاكمة الشخص أو معاقبته بسبب أصله العرقي أو ديانته أو جنسيته أو آرائه السياسية، أو بأن وضع هذا الشخص يمكن أن يضار ﻷي من هذه اﻷسباب.

Assistance under the Agreement may be partially or wholly waived if the requested Party believes that it may be harmful to sovereignty, security or law and order, or is contrary to its laws or international obligations.
