It commended the progress on the revision of the UNCITRAL Arbitration Rules and the decision to examine the topic of transparency in treaty-based investor-State arbitration as a matter of priority immediately after completion of the revision.
وأعربت عن إشادة الوفد بالتقدم المحرز في تنقيح قواعد الأونسيترال للتحكيم وبالقرار المتعلق بدراسة موضوع الشفافية في عمليات التحكيم بين المستثمرين والدول على أساس المعاهدات، على سبيل الأولوية مباشرة عقب إكمال عملية التنقيح.

In response, it was recalled that one of the purposes of the revision of the UNCITRAL Arbitration Rules was to include more time flexibility to establish a truncated tribunal, in order to address the difficulties arising in practice with arbitrators' withdrawals throughout the arbitral proceedings.

Future work in the field of settlement of commercial disputes should include the issue of arbitrability. Online dispute resolution and the implications of electronic communications should be considered, at least initially, in the context of the revision of the UNCITRAL Arbitration Rules.
وينبغي أن يتضمّن العمل في المستقبل في مجال تسوية المنازعات التجارية مسألة القابلية للتحكيم وينبغي بحث تسوية المنازعات بالاتصال الحاسوبي المباشر وآثار الخطابات الإلكترونية، في المرحلة الأوّلية على الأقل، في سياق تنقيح قواعد الأونسيترال للتحكيم.

أما بشأن تسوية النـزاعات بالاتصال الحاسوبي المباشر، فقد اتُّفق على أن يدرج الفريق العامل هذا الموضوع في جدول أعماله، على أن ينظر في مسألة الآثار المترتبة على الخطابات الإلكترونية، في مرحلة أولية على الأقل، في سياق تنقيح قواعد الأونسيترال للتحكيم.

After discussion, the Commission agreed that it would not be desirable to include specific provisions on treaty-based arbitration in the UNCITRAL Arbitration Rules themselves and that any work on investor-State disputes which the Working Group might have to undertake in the future should not delay the completion of the revision of the UNCITRAL Arbitration Rules in their generic form.

The Commission expressed the hope that the Working Group would complete its work on the revision of the UNCITRAL Arbitration Rules in their generic form, so that the final review and adoption of the revised Rules would take place at the forty-second session of the Commission, in 2009.

Online dispute resolution in a business context is indeed one of the items which the Commission requested Working Group I (International arbitration and conciliation) to place on its agenda but and consider, at least in an initial phase, in the context of the revision of the UNCITRAL Arbitration Rules.
