وتلاحظ اللجنة في هذا الصدد ندرة السوابق القضائية التي تم فيها التمسك بالحقوق المبينة في العهد أمام المحاكم الوطنية والتي قامت فيها هذه المحاكم بتطبيقها مباشرة.

(a) A " comprehensive " approach (allowing for communications under any of the rights of the Covenant);
(أ) النهج " الشامل " (إتاحة تقديم البلاغات بشأن أي حق من الحقوق التي ينص عليها العهد)؛

The Committee recommends that the State party ensure the existence of an effective legal and institutional framework for the promotion and protection of all the rights of the Covenant.
30- توصي اللجنة الدولة الطرف بالعمل على إيجاد إطار قانوني ومؤسسي فعال لتعزيز وحماية جميع الحقوق المنصوص عليها في العهد.

The Human Rights Committee in its general comment No. 15 specifies that the general rule is that each one of the rights of the Covenant must be guaranteed without discrimination between citizens and aliens.
وتؤكد اللجنة المعنية بحقوق الإنسان، في تعليقها العام رقم 15، أن القاعدة العامة تقضي بكفالة كل حق من الحقوق المنصوص عليها في العهد دون تمييز بين المواطنين والأجانب.

59. Australia's method of implementing the rights of the Covenant constituted a highly unsatisfactory patchwork of legislation, with the Constitution protecting only certain rights.
59- وتشكل طريقة أستراليا في تنفيذ الحقوق المنصوص عليها في " العهد " مزيجاً من التشريعات التي لا تبعث على الرضا إطلاقاً، في حين لا يوفر الدستور الحماية إلاّ لحقوق بعينها فقط.

523. The Committee considered that such a workshop might in fact be the first of a series of meetings designed to identify key benchmarks and indicators in relation to each of the rights of the Covenant.
523- وترى اللجنة أن حلقة العمل هذه يمكن أن تكون الأولى في سلسلة لقاءات هدفها تحديد العلائم والمؤشرات الرئيسية فيما يتعلق بكل حق من الحقوق المنصوص عليها في العهد.

557. The Committee recommends that the State party ensure the existence of an effective legal and institutional framework for the promotion and protection of all the rights of the Covenant.
557- وتوصي اللجنة الدولة الطرف بالعمل على إيجاد إطار قانوني ومؤسسي فعال لتعزيز وحماية جميع الحقوق المنصوص عليها في العهد.

The State party should urgently take action to close all children's institutions and establish practical alternatives to institutionalization with sufficient funds to create and maintain a sustainable system of care compatible with the rights of the Covenant.
ينبغي للجنة أن تتخذ فوراً إجراءات لإغلاق جميع مؤسسات رعاية الأطفال وأن تضع بدائل عملية تحل محل الإيداع في مؤسسات استشفائية وتمول تمويلاً كافياً لإنشاء نظام قابل للدوام والبقاء يتطابق مع الحقوق المنصوص عليها في العهد.

Nor may a State reserve an entitlement not to take the necessary steps at the domestic level to give effect to the rights of the Covenant (art. 2 (2)).
كما انه لا يجوز لدولة ان تحتفظ بحق عـــدم اتخــاذ التدابير اللازمة على المستوى الداخلي ﻹعمال الحقوق المنصوص عليها في العهد )المادة ٢، الفقرة ٢(.

He felt it was important to place more emphasis on the rights under the Covenant than on a State's powers to avail itself of the possibilities offered by article 4.
