2.2 Upon a written and binding election by the former Fund participant, the Pension Fund shall pay to the Staff Retirement Plan, upon request by AfDB, an amount equal to the larger of:

Whereas, the Regulations of the United Nations Joint Staff Pension Fund and the Staff Retirement Plan Regulations of the African Development Bank authorize the conclusion of such agreements with other international organizations for the transfer and continuity of such rights;
وحيث أن النظام الأساسي للصندوق المشترك للمعاشات التقاعدية لموظفي الأمم المتحدة والنظام الأساسي لخطة تقاعد موظفي مصرف التنمية الأفريقي يأذنان بإبرام اتفاقات من هذا القبيل مع منظمات دولية أخرى لنقل هذه الحقوق واستمراريتها؛

The parties acknowledge, however, that the status, rights or obligations of the participant in the Staff Retirement Plan as a participant in either party's pension scheme shall be determined by each party in accordance with their respective pension scheme.
غير أن الطرفين يقران أن وضع المشترِك في خطة تقاعد الموظفين وحقوقه وواجباته بصفته مشتركا في مخطط المعاشات التقاعدية لأحد الطرفين يحدد من جانب كل طرف وفقا لنظام المعاشات التقاعدية الخاص به.

These provisions shall also apply to the participant in the Staff Retirement Plan in the event of death or disability retirement during leave without pay under the Pension Fund Regulations, as long as no benefit election has been made under the regulations of the Staff Retirement Plan.

(b) The withdrawal benefit, to which the former participant in the Staff Retirement Plan would have been entitled under the Staff Retirement Plan, upon separation from the service of AfDB.

3.4 The maximum pensionable service credit granted in the Pension Fund by application of the present agreement cannot exceed the length of the actual past service that the concerned former participant in the Staff Retirement Plan had performed at AfDB.
3-4 لا يجوز لأقصى رصيد مدة الخدمة الداخل في حساب المعاش التقاعدي الممنوح في صندوق المعاشات التقاعدية تطبيقا لهذا الاتفاق أن يفوق مدة الخدمة السابقة الفعلية التي أداها المشترك السابق في خطة تقاعد الموظفين لدى المصرف.

2.4 Notwithstanding article 2.3 above, the maximum eligible contributory service recognized in the Staff Retirement Plan by application of the present agreement cannot exceed the length of the actual past service that the concerned former Fund participant had performed at a Pension Fund member organization.
2-4 بصرف النظر عن المادة 2-3 أعلاه، لا يجوز أن تفوق المدة القصوى للخدمة المستوفية للشروط المدفوع عنها اشتراكات التي يُعترف بها في خطة تقاعد الموظفين بتطبيق هذا الاتفاق مدة الخدمة السابقة الفعلية التي أداها المشترك السابق في الصندوق في إحدى المنظمات الأعضاء في صندوق المعاشات التقاعدية.

2.5 The amount payable by the Pension Fund to AfDB under article 2.2 shall in no event exceed the actuarial value required for the maximum eligible contributory service recognized in the Staff Retirement Plan as calculated by AfDB under article 2.4 of the present agreement.
2-5 لا يجوز بأي حال أن يفوق المبلغ المستحق الدفع من صندوق المعاشات التقاعدية إلى المصرف بموجب المادة 2-2 القيمة الاكتوارية اللازمة للمدة القصوى للخدمة المستوفية للشروط المدفوع عنها اشتراكات التي يُعترف بها في خطة تقاعد الموظفين وفقا لما يقوم بحسابه المصرف بموجب المادة 2-4 من هذا الاتفاق.

3.5 Following the election mentioned in article 3.2 above, the former participant in the Staff Retirement Plan may be required by AfDB to complete any formalities as necessary to ensure that the former participant shall cease to be entitled to any benefit under the Staff Retirement Plan.
3-5 عقب الاختيار المشار إليه في المادة 3-2 أعلاه، يجوز أن يطلب المصرف من المشترك السابق في خطة تقاعد الموظفين أن يكمل أي إجراءات ضرورية لضمان انتفاء حق ذلك المشترك السابق في الحصول على أي استحقاقات في إطار خطة تقاعد الموظفين.

4.5 The provisions of article 3 above shall apply if, upon the termination of the period of leave without pay, the participant in the Staff Retirement Plan ceases to be a participant in the Staff Retirement Plan and continues to be a Pension Fund participant and the former participant in the Staff Retirement Plan makes an election in writing to that effect within one year of the termination of the period of leave without pay.
4-5 تنطبق أحكام المادة 3 أعلاه عندما يتوقف المشترك في خطة تقاعد الموظفين عن الاشتراك فيها عند إنهاء فترة الإجازة بدون مرتب، ويستمر في اشتراكه في صندوق المعاشات التقاعدية، ويختار المشترك السابق في خطة تقاعد الموظفين ذلك خطيا في غضون سنة واحدة من إنهاء فترة الإجازة بدون مرتب.

7.2 Any individual participants in the Pension Fund or the Staff Retirement Plan may bring administrative actions against their employing organization or pension scheme, in accordance with their respective dispute-settlement mechanisms.
7-2 يجوز لأي من فرادى المشتركين في صندوق المعاشات التقاعدية أو خطة تقاعد الموظفين أن يتخذوا إجراءات إدارية ضد المنظمة التي يعملون فيها أو ضد مخطط المعاشات التقاعدية وفقا لآلياتهما الخاصة لتسوية المنازعات.

(a) The actuarial equivalent of the pension rights (and resultant accrued retirement benefit) acquired in the Staff Retirement Plan, the amount being calculated in accordance with the relevant regulations of the Staff Retirement Plan up to the date participation in the Staff Retirement Plan ceased; or
(أ) ما يعادل القيمة الاكتوارية لحقوق التقاعد (والاستحقاق التقاعدي المتراكم الناتج عنها) المكتسبة في إطار خطة تقاعد الموظفين، حيث يحسب المبلغ وفقا للقواعد ذات الصلة في خطة تقاعد الموظفين حتى التاريخ الذي انتهى فيه الاشتراك في الخطة؛ أو

2.3 Based on the amount transmitted by the Pension Fund under article 2.2 of the present agreement, the former Fund participant shall be credited with eligible contributory service in the Staff Retirement Plan in accordance with the applicable regulations of the Staff Retirement Plan, as of the date the relevant amount is received by AfDB for the Staff Retirement Plan.
2-3 على أساس المبلغ المنقول من صندوق المعاشات التقاعدية بموجب المادة 2-2 من هذا الاتفاق، تحتسب للمشترك السابق في الصندوق مدة خدمة مستوفية للشروط مدفوع عنها اشتراكات في خطة تقاعد الموظفين وفقا للقواعد المنطبقة من خطة تقاعد الموظفين اعتبارا من تاريخ استلام المصرف للمبلغ المذكور لفائدة خطة تقاعد الموظفين.

4.4 Subject to article 4.1, if a participant in the Staff Retirement Plan becomes a Fund participant during a period of leave without pay from AfDB and, upon the termination or expiration of such period (not exceeding three consecutive years when no contributions are made), ceases to be a Fund participant and resumes contributory service in the Staff Retirement Plan, no benefit becomes payable, but the provisions of article 2 above shall apply.
4-4 رهنا بأحكام المادة 4-1، عندما يصبح مشترِك في خطة تقاعد الموظفين مشتركا في الصندوق أثناء فترة إجازة بدون مرتب من المصرف، ويوقف اشتراكه في الصندوق عند إنهاء تلك الفترة أو انقضائها (دون تجاوز ثلاث سنوات متتالية عندما لا تُدفع أي اشتراكات)، ويستأنف الخدمة المدفوع عنها اشتراكات في خطة تقاعد الموظفين، لا يصبح أي استحقاق واجب الدفع، بل تنطبق أحكام المادة 2 أعلاه.

6.1 The implementation of the present agreement shall be subject to the Regulations and Administrative Rules of the United Nations Joint Staff Pension Fund and to the Regulations and Administrative Rules of the Staff Retirement Plan of the African Development Bank, as well as any respective internal implementation guidance and procedures established by either party.
6-1 يخضع تنفيذ هذا الاتفاق للنظامين الأساسي والإداري لصندوق المعاشات التقاعدية لموظفي الأمم المتحدة وللنظامين الأساسي والإداري لخطة تقاعد موظفي المصرف، وكذلك للتوجيهات والإجراءات الداخلية المتعلقة بالتنفيذ السارية لدى كل طرف على حدة.
