Excess of authority or contravention of instructions The conduct of an organ of a State or of a person or entity empowered to exercise elements of the governmental authority shall be considered an act of the State under international law if the organ, person or entity acts in that capacity, even if it exceeds its authority or contravenes instructions.

In some cases, a private actor's acts or omission of acts may be attributed to the State under international law.
ففي بعض الحالات، يمكن لفعل أو تقصير من جانب جهة فاعلة خاصة أن يُنسب إلى الدولة بموجب القانون الدولي.

We would note, however, that draft article 11 applies the converse rule to article 8: “The conduct of a person or a group of persons not acting on behalf of the State shall not be considered as an act of the State under international law.” This provision adds nothing to the draft.
غير أننا نلاحظ أن مشروع المادة ١١ يطبق القاعدة المعاكسة للمادة ٨، إذ تنص على ما يلي: " لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف شخص أو فريق من اﻷشخاص لا يعمل لحساب هذه الدولة " . فهذا الحكم لا يضيف شيئا إلى المشروع.

The conduct of an entity which is not an organ of the State under article 5 but which is empowered by the law of that State to exercise elements of the governmental authority shall be considered an act of the State under international law, provided the entity was acting in that capacity in the case in question [A/CN.4/L.569].

5. Under Article 3, two elements need to be established for an internationally wrongful act of a State; namely, an act or omission attributable to the State under international law; and secondly, that conduct has to constitute a breach of an international obligation owed by the offending State.

Thus, for example, the conduct of an organ of a railway company to which certain police powers have been granted will be regarded as an act of the State under international law if it falls within the exercise of those powers.
