2. A citizen of one Party who resides permanently in the territory of the other Party shall not enjoy the following rights:
٢ - لا يتمتع مواطن الطرف المقيم بصفة دائمة في إقليم الطرف اﻵخر بالحقوق التالية:

The acquisition of property by citizens of one Party who reside permanently in the territory of the other Party shall be subject to the legislation of the Party of residence.
٢ - أما شراء الممتلكات من قبل مواطني أحد الطرفين المقيمين بصفة دائمة في إقليم الطرف اﻵخر فتنظمه قوانين طرف اﻹقامة.

Matters relating to the performance of military service by citizens of one Party who reside permanently in the territory of the other Party shall be dealt with in a separate agreement.
المسائل المتصلة بإجراءات أداء مواطني أحد الطرفين المقيمين بصفة دائمة في إقليم الطرف اﻵخر للخدمة العسكرية ينظمها اتفاق منفصل.

2. The procedure indicated in paragraph 1 of this article shall apply to citizens of the Parties who reside permanently in the territory of the other Party, irrespective of the length of their residence in the territory of the Party whose citizenship they are acquiring.
١ - تنطبق الاجراءات المشار اليها في الفقرة ١ من هذه المادة على مواطني الطرفين المقيمين بصفة دائمة في اقليم الطرف اﻵخر بصرف النظر عن مدة إقامتهم في اقليم الطرف المراد الحصول على جنسيته.

The Parties shall ensure the unimpeded and timely transfer of pensions, allowances, alimony, monetary compensation for losses involving physical injury or other impairment of health, and other socially significant payments to citizens of one Party residing permanently or temporarily in the territory of the other Party.
ويكفل الطرفان المتعاقدان الساميان حرية وسرعة إجراء تحويلات المعاشات التقاعدية، والاستحقاقات، ونفقات اﻹعالة، ومبالغ التعويض عن اﻷضرار المرتبطة بالتشوهات أو اﻹصابات أو اﻷمراض اﻷخرى، أو المبالغ الاجتماعية المنشأ، إلى مواطني أحد الطرفين، من المقيمين إقامة دائمة أو مؤقتة في أراضي الطرف اﻵخر.

1. The legal capacity and competence of a citizen of one Party who resides permanently in the territory of the other Party shall be determined in accordance with the legislation of the Party of residence.
١ - الصفة القانونية واﻷهلية القانونية لمواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر يحددها قانون طرف اﻹقامة.

A citizen of one Party who resides permanently in the territory of the other Party shall not be restricted in his rights or be subject to additional obligations which are established, or which may be established, for foreign citizens in the Party of residence.
لا تنطبق على المواطن الذي يحمل جنسية أحد الطرفين ويقيم بصفة دائمة في إقليم الطرف اﻵخر تقييدات الحقوق أو الالتزامات اﻹضافية التي تطبق أو يمكن أن تطبق على الرعايا اﻷجانب في طرف اﻹقامة.

The Parties shall take measures to develop a bilateral contractual basis with respect to citizens of one Party who reside permanently in the territory of the other Party.
يتخذ الطرفان تدابير لتطوير قاعدة التعاقدية الثنائية المتعلقة بمواطن أحد الطرفين المقيمين بصفة دائمة في إقليم الطرف اﻵخر.

The Parties shall refrain from imposing any kind of restrictions with regard to the movement of people and goods to each other's territory or over the territory of either of the Parties to the territory of the other Party.
ويمتنع الطرفان عن فرض أي نوع من القيود فيما يتعلق بحركة الناس والبضائع الى إقليم كل منهما أو عبر إقليم أي من الطرفين الى إقليم الطرف اﻵخر.

1. A citizen of one Party who resides permanently in the territory of the other Party shall be bound to observe the Constitution and legislation and respect the traditions and customs of the Party of residence.
١ - مواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر ملزم بإطاعة دستور طرف اﻹقامة وقانونه وباحترام تقاليده وعاداته.

2. A citizen of one Party who resides permanently in the territory of the other Party shall maintain legal ties with the Party of citizenship and shall enjoy the protection of the two Parties.
٢ - يحتفظ مواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر بالروابط القانونية مع طرف الجنسية ويتمتع بالرعاية والحماية من الطرفين.

1. A citizen of one Party who resides permanently in the territory of the other Party shall enjoy the same rights and freedoms and be bound by the same obligations as citizens of the Party of residence, unless otherwise provided in this Treaty.
١ - يتمتع مواطن الطرف المقيم بصفة دائمة في إقليم الطرف اﻵخر بنفس الحقوق والحريات التي يتمتع بها مواطنو طرف اﻹقامة وتقع عليه نفس واجباتهم باستثناء ما هو منصوص عليه في هذه المعاهدة.

2. In cases where adoption is established or revoked, or guardianship or trusteeship is established or terminated, with respect to a citizen of one Party who resides permanently in the territory of the other Party, the law of the Party of citizenship shall apply.
٢ - تطبق تشريعات بلد الجنسية في الحالات التي يجاز أو يرفض فيها التبني أو يتم بها اﻹدخال في الوصاية أو الولاية أو اﻹخراج منهما بالنسبة لمواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر.

5. Each Contracting Party shall guarantee the same legal protection to the property of physical and legal persons having the citizenship of the other Party, that is, being seated in the territory of the other Party, as the one enjoyed by its own citizens, that is, its legal persons.
٥ - يكفل كل من الطرفين المتعاقدين من الحماية القانونية لممتلكات اﻷشخاص الطبيعيين والاعتباريين الذين يحملون جنسية الطرف اﻵخر، أي اﻷشخاص المقيمون في إقليم الطرف اﻵخر ما يماثل الحماية التي يتمتع بها من يحمل جنسيته، أي أشخاصها الاعتباريون.

2. The documents referred to in paragraph 1 of this article shall entitle a citizen of one Party who resides permanently in the territory of the other Party to matriculate in educational institutions situated in the territories of the two Parties and shall be valid for the purpose of obtaining employment in the speciality indicated in the documents.
٢ - الوثائق المشار إليها في الفقرة ١ من هذه المادة تعطي مواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر الحق في الالتحاق بالمؤسسات التعليمية الموجودة في أراضي الطرفين، كما أنها صالحة للتوظيف في التخصص الموضح فيها.

3. If, at the time this Treaty enters into force, a citizen of one Party who resides permanently in the territory of the other Party has exercised his right to take part in the privatization of the State property of one of the Parties, he shall not be entitled to participate in the privatization of the State property of the other Party.
٤ - في لحظة دخول هذه المعاهدة حيز النفاذ، إذا مارس مواطن أحد الطرفين المقيم بصفة دائمة في إقليم الطرف اﻵخر حقه في المشاركة في خصخصة ممتلكات الدولة في أحد البلدين، فلا يحق له أن يشارك في خصخصة ممتلكات الدولة في الطرف اﻵخر.

1. Each Party shall offer its citizens who take up permanent residence in the territory of the other Party a simplified (registration) procedure for the acquisition of citizenship, provided that they meet one of the following conditions:
١ - يتيح كل طرف من الطرفين لمواطنيه الوافدين لﻹقامة الدائمة في إقليم الطرف اﻵخر استخدام اجراءات )تسجيل( مبسطة للحصول على الجنسية اذا توفر لدى هؤلاء المواطنين أحد الشروط التالية:

1. For the purposes of this Agreement, a citizen of one Party is considered to be a permanent resident in the territory of the other Party if he resides permanently in its territory on the basis of a permit issued by the other Party and is not at the same time a permanent resident in the territory of the Party of which he holds citizenship.
١ - ﻷغراض هذه المعاهدة، يعتبر مواطن أحد الطرفين مقيما بصفة دائمة في اقليم الطرف اﻵخر إذا كان يقيم بصفة دائمة في اقليم هذا الطرف اﻵخر بناء على تصريح صادر منه، وفي الوقت نفسه لا يقيم بصفة دائمة في أراضي الطرف الذي يحمل جنسيته.

The Parties shall refrain, in accordance with the purpose and principles of the Charter of the United Nations, from the threat or use of force designed to violate their existing frontier, and they agree that neither of them will assert or support claims to any part of the territory of the other Party or claims for a change of their existing frontier.
يمتنع الطرفان، وفقا لمقاصد ومبادئ ميثاق اﻷمم المتحدة، عن التهديد باستخدام القوة أو اللجوء الى استخدامها بهدف انتهاك الحدود القائمة بينهما، ويتفقان على ألا يدعي بأي مطالبات في أي جزء من أراضي الطرف اﻵخر أو يؤيد أية مطالبات من هذا القبيل أو يطالب بتغيير الحدود الراهنة.

The Presidents expressed their support for the further intensification of Kazakh-Russian cooperation in the humanitarian field, including constructive interaction to guarantee the rights of citizens and subjects of the parties residing in the territory of the other Party.
وأعرب الرئيسان عن تأييدهما لزيادة تنشيط التعاون الكازاخستاني - الروسي في المجال اﻹنساني، بما في ذلك التعاون البنﱠاء في مسائل ضمان حقوق مواطني وأبناء الطرفين، المقيمين في أراضي الطرف اﻵخر.
