And the clauses for foreign jurisdiction mentioned on the transport document or electronic transport record are helpful for the concerned party to start legal proceedings.
وتساعد شروط الولاية القضائية الأجنبية المذكورة في مستند النقل أو سجل النقل الإلكتروني الطرف المعني على بدء إجراءات قانونية.

1. If a carrier is identified by name in the contract particulars, any other information in the transport document or electronic transport record relating to the identity of the carrier shall have no effect to the extent that it is inconsistent with that identification.
1- إذا كان الناقل محددا بالاسم في تفاصيل العقد، لم يعد لأي معلومات أخرى واردة في مستند النقل أو سجل النقل الإلكتروني فيما يتعلق بهوية الناقل أي مفعول قانوني متى كانت لا تتسق مع ذلك الاسم المحدّد.

(b) The carrier has reasonable grounds to believe that a material statement in the transport document or electronic transport record is false or misleading.
(ب) كانت لدى الناقل أسباب معقولة للاعتقاد بأن بيانا أساسيا في مستند النقل أو سجل النقل الإلكتروني زائف أو مضلّل.

An alternative suggestion was made to replace the bracketed text with the words " and such agreement is included in the contract particulars [or incorporated by reference in the transport document or electronic transport record]. "
وقُدّم اقتراح بديل يدعو إلى الاستعاضة عن النص المدرج بين معقوفتين بالعبارة " ويُدرج ذلك الاتفاق في تفاصيل العقد [أو يُدرج بالإشارة إليه في مستند النقل أو سجل النقل الإلكتروني]. "

(ب) وأي تفقّد إضافي يقوم به الناقل أو الطرف المنفِّذ فعليا قبل إصدار مستند النقل أو سجل النقل الإلكتروني.
