Both regular and irregular migrants should therefore enjoy, inter alia, freedom of expression or association; freedom from racial discrimination in the areas of education or health; the right to equal treatment before the tribunals and all other organs administering justice; and a guarantee of their physical integrity by the State concerned.

In addition, article 5 of the International Convention on the Elimination of All Forms of Racial Discrimination, which is binding on 162 States, provides, among other things, for " the right to equal treatment before the tribunals and all other organs administering justice " .
ومن جهة أخرى، فإن المادة 5 من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، والتي تسري على 162 دولة(36) تنص، من جملة ما تنص، على " الحق في معاملة على قدم المساواة أمام المحاكم وجميع الهيئات الأخرى التي تتولى إقامة العدل " .

وإذ تشير إلى أحكام المادة 5(أ) من الاتفاقية التي يقع على عاتق الدول الأطراف بموجبها التزام بضمان حق كل فرد، دون أي تمييز على أساس العرق أو اللون أو الأصل القومي أو الإثني، في المساواة أمام القانون، ولا سيما في التمتع بالحق في المعاملة المتساوية أمام المحاكم وجميع الأجهزة الأخرى التي تتولى إقامة العدل،

There is insufficient information on article 5 (a) and (b) of the Convention, and in particular whether everyone enjoys the right to " equal treatment before the tribunals and all other organs administering justice " and to " security of person and protection by the State against violence or bodily harm, whether inflicted by government officials or by any individual group or institution " .
