The present note provides background information on the legislative procedures to be followed for the appointment of the Director-General, in line with the UNIDO Constitution and the rules of procedure of the Industrial Development Board and the General Conference.
تقدِّم هذه المذكّرة معلومات أساسية عن الإجراءات التشريعية التي ينبغي اتِّباعها بشأن تعيين المدير العام، بما يتماشى مع دستور اليونيدو ومع النظام الداخلي لمجلس التنمية الصناعية والمؤتمر العام.

In view of this, I would like to ask the General Conference of the UNIDO to take a positive decision on restoring Lithuania's right to vote, commencing with the 10th session of the General Conference, based on the provisions of Article 5 of the UNIDO Constitution.

Since Singapore and the United States were not Member States of UNIDO, the States in List A in Annex I to the UNIDO Constitution had submitted the candidature of Kazakhstan to replace Singapore and the States in List B had submitted the candidature of France to replace the United States.

In accordance with its functions, as mandated by the UNIDO Constitution and as reflected in the rules of procedure, the terms of reference of the Board are deemed to be sufficiently broad and its authority sufficiently adequate to carry out its oversight functions.

3. Article 5.2 of the UNIDO Constitution stipulates that any organ may permit a Member in arrears to vote in that organ if it is satisfied that the failure to pay is due to conditions beyond the control of the Member.
3- تنصّ المادة 5-2 من دستور اليونيدو على أنه يجوز لأي هيئة أن تسمح لعضو عليه متأخّرات بأن يصوّت في تلك الهيئة إذا اقتنعت بأن عدم الدفع راجع إلى ظروف خارجة عن إرادة ذلك العضو.

(d) Gives satisfaction to the request by Moldova for the restoration of its voting rights in accordance with Article 5.2 of the UNIDO Constitution.
(د) يعرب عن استجابته إلى طلب مولدوفا بشأن استعادة حقوقها في التصويت، وفقاً للمادة 5-2 من دستور اليونيدو.

Article 5.2 of the UNIDO Constitution stipulates that any organ may permit a Member in arrears to vote in that organ if it is satisfied that the failure to pay is due to conditions beyond the control of the Member.

As provided in Article 11.5 of the UNIDO Constitution, “The conditions of service of staff shall conform as far as possible to those of the United Nations common system”.
٥١ - تنص المادة ١١-٥ من دستور اليونيدو على أن " تكون شروط خدمة موظفي اليونيدو مطابقة قدر اﻹمكان لشروط النظام الموحد لﻷمم المتحدة " .

7. We are aware that the UNIDO Constitution provides that only six per cent of the regular budget of the Organization may be used for promotion of technical cooperation programmes.
٧ - واننا ندرك أن دستور اليونيدو ينص على أن نسبة ٦ في المائة فقط من الميزانية العادية للمنظمة يمكن أن يستخدم للنهوض ببرامج التعاون التقني .

12. Article 8, paragraph 3 (d), of the UNIDO Constitution states:
12- تنص المادة 8، الفقرة 3 (د)، من دستور اليونيدو على ما يلي:

A welcome development occurred in October, when South Africa acceded to the UNIDO Constitution, thereby becoming the 169th Member State.
وحدث تطور سار في تشرين الأول/أكتوبر عندما انضمت جنوب أفريقيا إلى دستور اليونيدو فأصبحت بذلك الدولة العضو المائة والتاسعة والستين.

As the matter constitutes a policy decision, the document also initiates the process of approval for the adoption of IPSAS by the General Conference in 2007, in accordance with the UNIDO Constitution (Article 8, para. 3 (a)).
