9. The Parties shall require that each person who takes charge of a transboundary movement of hazardous wastes or other wastes sign the movement document either upon delivery or receipt of the wastes in question.
9 - على الأطراف أن تشترط أن يقوم كل شخص مسؤول عن نقل نفايات خطرة أو نفايات أخرى عبر الحدود بالتوقيع على وثيقة النقل إما عند تسليم النفايات قيد النظر أو استلامها.

(a) " Written consent " and " confirmation of the existence of a contract between the exporter and the disposer specifying environmentally sound management of the wastes in question " (art. 6 (3) (a) (b)); and

When transboundary movement of hazardous and other wastes for which consent has been given by the countries concerned cannot be completed, the country of export is to ensure that the wastes in question are taken back into the country of export for their disposal if alternative arrangements cannot be made.
69 - وعندما لا يتسنى استكمال نقل النفايات الخطرة وغيرها من النفايات عبر الحدود، والذي وافقت عليه البلدان المعنية، يضمن البلد المصدر إعادة النفايات المعينة إلى البلد المصدر للتخلص منها إذا لم يتسن وضع ترتيبات بديلة لذلك.

In addition, there are outright bans on the export of these wastes if the exporting state " has reason to believe the wastes in question will not be disposed of in an environmentally sound manner. "

في حال عدم التمكن من إتمام نقل عبر الحدود لنفايات خطرة وغيرها من النفايات والتي مُنحت موافقة البلدان المعنية، فإن بلد التصدير سيضمن عودة النفايات محل السؤال إلى بلد التصدير للتخلص منها إذا كان لا يمكن عمل ترتيبات بديلة.

The notifier has received from the State of import confirmation of the existence of a contract between the exporter and the disposer specifying environmentally sound management of the wastes in question.
(ب) وأن المخطِر تلقى تأكيدات من دولة الاستيراد عن وجود عقد بين المصدِّر والمتخلص يحدد الإدارة السليمة بيئياً للنفايات المقصودة.

2. In case of a transboundary movement of hazardous wastes or other wastes deemed to be illegal traffic as the result of conduct on the part of the exporter or generator, the State of export shall ensure that the wastes in question are:
2- في الحالة التي تعتبر فيها نقل نفايات خطرة أو نفايات أخرى عبر الحدود اتجاراً غير مشروع لكونها نتيجة تصرف قام به المصدِّر أو المولِّد، تضمن دولة التصدير أن النفايات قيد النظر:

In the case of a transboundary movement deemed to be illegal traffic as the result of conduct on the part of the importer or disposer, the State of import is to ensure that the wastes in question are disposed of in an environmentally sound manner by the importer or disposer or, if necessary, by itself.
وفي الحالة التي تعتبر فيها حركة نفايات خطرة ونفايات أخرى عبر الحدود اتجاراً غير مشروع لكونها نتيجة تصرف قام بها المستورد أو المتخلص، تضمن دولة الاستيراد أن يتولى المستورد أو المتخلص، أو هي ذاتها عند اللزوم، التخلص من النفايات قيد النظر بطريقة سليمة بيئياً.

In the case of illegal traffic (as defined in article 9, paragraph 1), the country of export shall ensure that the wastes in question are taken back into the country of export for their disposal or disposed of in accordance with the provisions of the Basel Convention.
في حالة الاتجار غير المشروع (كما ورد في المادة 9، الفقرة1)، يضمن البلد التصدير عودة النفايات قيد النظر إلى بلد التصدير للتخلص منها أو يتم التخلص منها وفقاً لأحكام اتفاقية بازل.

(g) Prevent the import of hazardous wastes and other wastes if it has reason to believe that the wastes in question will not be managed in an environmentally sound manner;
(ز) صنع استيراد النفايات الخطرة والنفايات الأخرى إذا كان لديه سبب يحمله على الاعتقاد بأن النفايات قيد النظر لن تدار بطريقة سليمة بيئياً؛

(b) The notifier has received from the State of import confirmation of the existence of a contract between the exporter and the disposer specifying environmentally sound management of the wastes in question.

If the take-back is impracticable, the State of export is to ensure that the wastes in question are otherwise disposed of in accordance with the provisions of the Basel Convention.
وإذا تعذر إعادة هذه النفايات من الناحية العملية، على الدولة المصدرة أن تضمن التخلص منها وفقاً لأحكام اتفاقية بازل.()

When transboundary movement of hazardous and other wastes to which consent of the countries concerned has been given cannot be completed, the country of export shall ensure that the wastes in question are taken back into the country of export for their disposal if alternative arrangements cannot be made.
51- في حال عدم التمكن من إتمام نقل عبر الحدود لنفايات خطرة وغيرها من النفايات والتي مُنحت موافقة البلدان المعنية، فإن بلد التصدير سيضمن عودة النفايات محل السؤال إلى بلد التصدير للتخلص منها إذا كان لا يمكن عمل ترتيبات بديلة.

(d) If the wastes in question are required as a raw material for recycling or recovery industries in the country of import; or
(د) عندما تحتاج النفاية محل السؤال على اعتبار أنها مادة خام إلى صناعات لإعادة التدوير والاستعادة في بلد الاستيراد؛ أو

(c) If the country of export does not have the technical capacity and the necessary facilities to dispose of the wastes in question in an environmentally sound and efficient manner;
(ج) إذا لم يكن لدى بلد التصدير القدرات التقنية والمرافق الضرورية للتخلص من النفايات المعنية بصورة سليمة بيئياً وفعالة؛
