1. Internally displaced persons who have returned to their homes or places of habitual residence or who have resettled in another part of the country shall not be discriminated against as a result of their having been displaced.
1- لا يجوز التمييز ضد الأشخاص المشردين داخلياً الذين عادوا إلى ديارهم أو أماكن إقامتهم المعتادة أو المعاد توطينهم في مكان آخر من البلد، بحكم وضعهم السابق كمشردين.

“Conscious that serious human rights violations and breaches of international humanitarian law are among the reasons why people flee their homes or places of habitual residence and become refugees or internally displaced persons,
" وإذ تعي أن الانتهاكات الخطيرة لحقوق الإنسان، وحالات خرق القانون الإنساني الدولي، تعد من بين الأسباب التي تدفع الأشخاص للفرار من ديارهم أو أماكن إقامتهم المعتادة ليصبحوا لاجئين أو مشردين داخلياً،

1. Competent authorities have the primary duty and responsibility to establish conditions, as well as provide the means, which allow internally displaced persons to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country.
1- يقع على عاتق السلطات المختصة، في المقام الأول، واجب ومسؤولية تهيئة الظروف وتوفير الوسائل لتمكين المشردين داخلياً من العودة الطوعية، آمنين مكرّمين، إلى ديارهم أو أماكن إقامتهم المعتادة أو التوطن الطوعي في مكان آخر من البلد.

Thus, the Guiding Principles use a broad notion of " internally displaced persons " as persons " forced or obliged to flee or leave their homes or places of habitual residence " for an array of reasons including " natural disaster " .
لذلك، تستخدم المبادئ التوجيهية مفهوما واسعاً لتعريف " المشردين داخليا " إذ تعتبرهم أشخاصا " أُكرهوا على الهرب أو على ترك منازلهم أو أماكن إقامتهم المعتادة " لجملة من الأسباب منها " الكوارث الطبيعية " .

83. Internally displaced persons have a right to voluntary return in safety to their homes or places of habitual residence as soon as the reasons for their displacement cease to exist, or, as citizens of the country they are living in, to remain or resettle in another part of the country.
83- وللمشرَّدين داخلياً الحق في العودة الطوعية والآمنة إلى منازلهم أو أماكن إقامتهم المعتادة متى زالت أسباب نزوحهم()، أو لهم الحق، بصفتهم مواطنين في البلد الذي يعيشون فيه، في البقاء أو الانتقال للتوطُّن في موقع آخر من البلد().

2. Principle 28 recognizes that the competent authorities have the primary duty and responsibility to establish conditions, as well as provide the means, which allow IDPs to return voluntarily, in safety and with dignity, to their homes or places of habitual residence, or to resettle voluntarily in another part of the country.
2- ويعترف المبدأ 28 بأنه يقع على عاتق السلطات المختصة في المقام الأول واجب ومسؤولية تهيئة الظروف وتوفير الوسائل اللازمة لتمكين المشردين داخلياً من العودة الطوعية، آمنين مُكرَّمين، إلى ديارهم أو أماكن إقامتهم المعتادة أو التوطُّن الطوعي في مكان آخر من البلد.

For the purposes of these Principles, internally displaced persons are persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border.
2- ولغرض هذه المبادئ، يُقصد بالمشردين داخلياً الأشخاص أو جماعات الأشخاص الذين أُكرهوا على الهرب أو على ترك منازلهم أو أماكن إقامتهم المعتادة أو اضطروا إلى ذلك، ولا سيما نتيجة أو سعياً لتفادي آثار نزاع مسلح أو حالات عنف عام الأثر أو انتهاكات حقوق الإنسان أو كوارث طبيعية أو كوارث من فعل البشر ولم يعبروا الحدود الدولية المعترف بها للدولة.

40. The Guiding Principles define internally displaced person as " persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflicts, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized state border " .
40 - وتعرِّف المبادئ التوجيهية المشردين داخليا بأنهم " الأشخاص أو الجماعات من الأشخاص الذين أُكرهوا على الهرب أو على ترك منازلهم أو أماكن إقامتهم المعتادة أو اضطروا إلى ذلك، ولا سيما نتيجة أو سعيا لتفادي آثار صراع مسلح أو حالات عنف عام أو انتهاكات لحقوق الإنسان أو كوارث طبيعية أو كوارث من فعل البشر، ولم يعبروا الحدود الدولية المعترف بها للدولة " .

105. The ICRC commentary on customary international humanitarian law declares that, " displaced persons have a right to voluntary return in safety to their homes or places of habitual residence as soon as the reasons for their displacement cease to exist " and concludes that State practice has established this principle as a norm of customary international law in both international and non-international armed conflicts.
105 - ويشير تعليق لجنة الصليب الأحمر الدولية على القانون الإنساني الدولي العرفي إلى أن " للمشرَّدين داخلياً الحق في العودة الطوعية والآمنة إلى منازلهم أو أماكن إقامتهم المعتادة متى زالت أسباب نزوحهم " ، ويخلص إلى أن ممارسات الدول أرست هذا المبدأ بوصفه قاعدة معيارية من قواعد القانون الدولي العرفي المعمول بها في النزاعات المسلحة الدولية وغير الدولية على السواء().
