This Part specifically invites States to identify whether they are bound by particular treaty provisions or otherwise consider themselves bound at customary international law.

However, we believe that the existence and scope of application of such a rule may be established only if relevant State practice is identified in the absence of treaty obligations, together with evidence that States act as they do precisely because they consider themselves bound by a rule of law.
