Mr. Titiahonjo asked why he was arrested but he received no answer.

Mr. Titiahonjo, however, continued to be held incommunicado and to be illtreated.
غير أن السيد تيتياهونجو ظل مسجوناً في الحبس الانفرادي كما ظل يتعرض لإساءة المعاملة.

Mr. Titiahonjo was transferred to Bafoussam military prison.
ونُقل السيد تيتياهونجو إلى سجن بافوسام العسكري.

The Committee considered that the State party had not fulfilled its obligation under article 6, paragraph 1, of the Covenant, to protect Mr. Titiahonjo's right to life.

2.7 In the morning of 14 September 2000 Mr. Titiahonjo complained of a stomach ache and asked for medication.

Mr. Titiahonjo continued to call for help throughout the day, but when his cell was finally opened at 9 p.m. the same day, he was already dead.
واستمر السيد تيتياهونجو يطلب نجدته طوال اليوم ولكن عندما أمكن أخيراً فتح باب الزنزانة في الساعة التاسعة مساءً من نفس اليوم كانت قد وافته المنية.

In these circumstances, the Committee finds that the State party did not fulfil its obligation under article 6, paragraph 1, of the Covenant, to protect Mr. Titiahonjo's right to life.
وترى اللجنة، في ظل هذه الظروف، أن الدولة الطرف لم تفِ بالتزامها بحماية حق السيد تيتياهونجو في الحياة عملاً بالفقرة 1 من المادة 6 من العهد.

In the circumstances, the Committee concludes that Mr. Titiahonjo was subjected to cruel, inhuman and degrading treatment, in violation of article 7 of the Covenant.
وفي ظل هذه الظروف، تخلص اللجنة إلى أن السيد تيتياهونجو تعرض لمعاملة قاسية ولا إنسانية وحاطة بالكرامة انتهاكاً للمادة 7 من العهد.

In the absence of any relevant State party information, the Committee considers that Mr. Titiahonjo's deprivation of liberty was arbitrary and in violation of article 9, paragraph 1.
وفي غياب وجود أي معلومات ذات صلة مقدمة من الدولة الطرف، ترى اللجنة أن حرمان السيد تيتياهونجو من حريته كان تعسفياً وشكل انتهاكاً للفقرة 1 من المادة 9.

In the circumstances, the Committee concluded that Mr. Titiahonjo had been subjected to cruel, inhuman and degrading treatment, in violation of article 7 of the Covenant.
وفي ظل هذه الظروف، خلصت اللجنة إلى أن السيد تيتياهونجو تعرض لمعاملة قاسية ولا إنسانية وحاطة بالكرامة انتهاكاً للمادة 7 من العهد.

She was mistreated by the police and pushed into the gutter and slapped when they arrested Mr. Titiahonjo on the 19 May 2000.

6.5 With regard to the claim under article 9, paragraph 1, it transpires from the file that no warrant was ever issued for Mr. Titiahonjo's arrest or detention.
6-5 وفيما يتعلق بالادعاء المقدم في إطار الفقرة 1 من المادة 9، يتبين من الملف أنه لم يصدر في أي وقت من الأوقات أي أمر بتوقيف السيد تيتياهونجو أو باعتقاله.

Nothing suggest that Mr. Titiahonjo was ever informed of the reasons for his arrest, that he was ever brought before a judge or judicial officer, or that he ever was afforded the opportunity to challenge the lawfulness of his arrest or detention.
ولا يوجد ما يدل على أن السيد تيتياهونجو أُبلِغ في أي وقت من الأوقات بأسباب توقيفه، أو أنه مثل قط أمام أحد القضاة أو أمام أي موظف قضائي، أو أنه أعطي في أي وقت من الأوقات فرصة الطعن في قانونية توقيفه أو اعتقاله.

3.5 The author alleges a violation of article 19 in that Captain Togolo maintained that Mr. Titiahonjo belonged to the SCNC, an allegedly " secessionist organization " .
