64. The travaux préparatoires will indicate that the statement of facts may include a description of the illicit activity and its relationship to the assets to be confiscated.
64- سوف تبين " الأعمال التحضيرية " أن بيان الوقائع يجوز أن يتضمن وصفا للنشاط غير المشروع وعلاقته بالموجودات المراد مصادرتها.

(a) In the case of a request pertaining to paragraph 1 (a) of this article, a description of the property to be confiscated, including, to the extent possible, the location and, where relevant, the estimated value of the property and a statement of the facts relied upon by the requesting State Party sufficient to enable the requested State Party to seek the order under its domestic law;
(أ) في حالة طلب ذي صلة بالفقرة 1 (أ) من هذه المادة، وصفا للممتلكات المراد مصادرتها بما في ذلك مكان الممتلكات وقيمتها المقدّرة، حيثما تكون ذات صلة، وبيانا بالوقائع التي استندت إليها الدولة الطرف الطالبة يكفي لتمكين الدولة الطرف متلقية الطلب من استصدار الأمر في إطار قانونها الداخلي؛

The judge may order that property to be confiscated should be replaced by a claim for compensation lodged by the State for an equivalent amount, which would include, where applicable, the yield of the assets to be confiscated.
ويجوز للقاضي أن يأمر بأن تُستبدل بالممتلكات المقرر مصادرتها دعوى تعويض بمبلغ مكافئ ترفعها الدولة وتشمل، حسب الاقتضاء، عائدات الأصول المقرر مصادرتها.
