وتشير اللجنة إلى تعليقها العام رقم 1 المتعلق بالمادة 3 الذي جاء فيه أن على اللجنة أن تقيّم ما إذا كانت توجد أسباب حقيقية للاعتقاد بأن صاحب الشكوى سيواجه خطر التعرض للتعذيب إذا ما طُرد أو أُعيد أو سُلِّم، وأن خطر التعرض للتعذيب يجب تقييمه على أسس تتجاوز مجرد الافتراض والشك.

6. Bearing in mind that the State party and the Committee are obliged to assess whether there are substantial grounds for believing that the author would be in danger of being subjected to torture were he/she to be expelled, returned or extradited, the risk of torture must be assessed on grounds that go beyond mere theory or suspicion.
٦ - إذا وضع في الاعتبار أن على الدولة الطرف واللجنة إلتزاما بتقدير ما إذا كانت هناك أسباب جوهرية للاعتقاد بأن الفاعل سيتعرض لخطر التعذيب إذا طرد أو أعيد أو سلم، يجب أن يقدر خطر التعذيب على أسس تتجاوز مجرد النظرية أو الشك.

(e) Has the author engaged in political or other activity within or outside the State concerned which would appear to make him/her particularly vulnerable to the risk of being placed in danger of torture were he/she to be expelled, returned or extradited to the State in question?

The decision on administrative expulsion may be appealed against within seven days to the Prime Minister of the Republic of Armenia by the foreign citizen to be expelled or by a representative of the state who defends his interests.

7- وأشار إلى أن الفقرة 235 من التقرير تذكر أن الأجانب المزمع طردهم من الجمهورية التشيكية يجوز احتجازهم في زنزانة من زنزانات الشرطة لمدة تصل إلى 30 يوماً.

Invoking the case law of the European Court of Human Rights, the State party notes that the Court has only found a violation of article 3 of the European Convention on Human Rights in very exceptional circumstances when the person to be expelled had reached the advanced stages of AIDS and would face a lack of treatment as well as a lack of social and moral support in the receiving country.
واستناداً إلى السوابق القضائية للمحكمة الأوروبية لحقوق الإنسان، تلاحظ الدولة الطرف أن المحكمة لم تجد انتهاكاً للمادة 3 من الاتفاقية الأوروبية لحقوق الإنسان إلا في ظروف استثنائية جداً، وذلك عندما بلغت إصابة الشخص المقرر ترحيله بمرض الإيدز مرحلة متقدمة، وكان سيفتقر إلى العلاج وإلى الدعم الاجتماعي والمعنوي في البلد المستقبل(ﻫ).

7-3 وتذكّر اللجنة بتعليقها العام رقم 1(1996) على المادة 3(س) ومفاده أن اللجنة ملزمة بتقييم ما إذا كانت هناك أسباب جوهرية تدعو إلى الاعتقاد أن مقدم البلاغ سيتعرض لخطر التعذيب إن هو طرد أو أُعيد أو سُلم، ويجب أن يقدر خطر التعذيب على أسس تتجاوز مجرد الافتراض أو الشك.

The average duration of detention at the Foreigners' Registration Centre of persons to be expelled is approximately two months.
ويقدر متوسط فترة احتجاز الأشخاص المقرر طردهم في مركز تسجيل الأجانب بحوالي شهرين.
