In this respect, the right of anyone deprived of his or her liberty to bring proceedings before a court in order to challenge the legality of the detention is a personal right, which must in all circumstances be guaranteed by the jurisdiction of the ordinary courts. "

84. The right to challenge the legality of the deprivation of liberty includes not only the right to appeal, but also the right to access the court, or other competent, independent and impartial authority or judicial body, in cases where the deprivation of liberty is an administrative decision (e.g. the police, the prosecutor and other competent authority).
84- ولا يشمل الحق في الطعن في شرعية الحرمان من الحرية حق الطعن فحسب، بل يشمل أيضاً الحق في الوصول إلى المحكمة أو سلطة أو هيئة قضائية مختصة ومستقلة ونزيهة أخرى في الحالات التي يستند فيها الحرمان من الحرية إلى قرار إداري (من الشرطة أو المدعي العام أو سلطة مختصة أخرى مثلاً).

It guarantees to every child deprived of his or her liberty " the right to prompt access to legal and other appropriate assistance, as well as the right to challenge the legality of the deprivation of his or her liberty before a court or other competent, independent and impartial authority, and to a prompt decision on any such action " (art. 37 (d)).
