439. In accordance with this article, if the Committee receives information which appears to contain well-founded indications that torture is being systematically practised in the territory of a State party, it shall invite the State party to cooperate in the examination of the information and, if warranted, assign members to undertake a confidential inquiry.

2- إذا تلقت اللجنة معلومات موثوقة تدل على وقوع انتهاكات جسيمة أو منتظمة من جانب دولة طرف لأي من الحقوق الاقتصادية أو الاجتماعية أو الثقافية المنصوص عليها في العهد، تدعو اللجنة تلك الدولة الطرف إلى التعاون في فحص المعلومات وإلى تقديم ملاحظاتها بشأن هذه المعلومات.
