However, it is recognized that, pursuant to article 91 of UNCLOS, every State is entitled to fix the conditions for the grant of its nationality to ships, for the registration of ships in its territory and for the right to fly its flag.

This interpretation necessarily derives from the right acknowledged by the United Nations Convention on the Law of the Sea, article 91, paragraph 1, of every State to fix the conditions for the grant of its nationality to ships, for the registration of ships in its territory and for the right to fly its flag.
ويُستمَد هذا التفسير بالضرورة من الحق المعترف به في الفقرة 1 من المادة 91 من اتفاقية الأمم المتحدة لقانون البحار لكل دولة في تحديد شروط منح جنسيتها للسفن ولتسجيل السفن في إقليمها وللحق في رفع علمها.

Morocco pointed out that the problem of " flags of convenience " did not arise in its case because the link between the State of Morocco and the vessels flying its flag was " genuine " by reason of the strict conditions imposed on fishing vessels wishing to fly its flag.
وأشارت المغرب إلى أن مشكلة " أعلام الملاءمة " لم تنشأ في حالتها لأن الصلة بين دولة المغرب والسفن التي ترفع علمها " صلة حقيقية " بداعي الشروط الحازمة التي تفرضها على سفن الصيد التي ترغب في رفع علمها.

“(a) Verifying the vessel’s right to fly its flag: the vessel may be requested to give information on its nationality and the nationality of its crew, its port of departure and its destination;
" )أ( التأكد من حق السفينة في رفع علمها : يجوز أن يطلب من السفينة اعطاء معلومات عن جنسيتها وجنسية طاقمها ، وعن الميناء الذي أبحرت منه وجهة مقصدها ؛

184. Article 91 of UNCLOS requires every State to fix the conditions for the grant of its nationality to ships, for the registration of ships in its territory and for the right to fly its flag.
١٨٤ - وتقتضي المادة ٩١ من اتفاقية اﻷمم المتحدة لقانون البحار أن تحدد كل دولة شروط منح جنسيتها للسفن ولتسجيل السفن في إقليمها وللحق في رفع علمها.

27. The flag State shall ensure compliance by vessels entitled to fly its flag with applicable conservation and management measures and international minimum standards.
٧٢ - تضمن دولة العلم امتثال السفن ذات الحق في رفع علمها لتدابير الحفظ والادارة المنطبقة والمعايير الدولية للحدود الدنيا.

(a) adopt legislation and administrative measures to ensure that vessels entitled to fly its flag comply with applicable conservation and management measures;
)أ( اعتماد تشريعات وتدابير ادارية لضمان امتثال السفن ذات الحق في رفع علمها لتدابير الحفظ والادارة المنطقبة؛

Angola stated in its notification that its authority to receive and respond to requests for assistance, for confirmation of registry or of the right of a vessel to fly its flag and for authorization to take appropriate measures was as follows:
300- وذكرت أنغولا في إبلاغها أن سلطتها التي تتلقى طلبات المساعدة وطلبات تأكيد تسجيل السفينة أو حقها في رفع علمها وطلبات الاستئذان باتخاذ التدابير المناسبة وترد على تلك الطلبات هي:

25. The flag State shall effectively exercise its jurisdiction and control over vessels entitled to fly its flag and shall authorize such vessels to be used for fishing on the high seas only where it is able to exercise effectively its responsibilities in respect of such vessels under the Convention and the provisions of this document.
٥٢ - تمارس دولة العلم ولايتها بصورة فعالة على السفن ذات الحق في رفع علمها وتراقبها بصورة فعالة، ولا تأذن لهذه السفن بأن تستعمل في صيد اﻷسماك في أعالي البحار إلا اذا كانت قادرة على ممارسة مسؤولياتها بفاعلية فيما يختص بمثل هذه السفن بمقتضى الاتفاقية وأحكام هذه الوثيقة.

41. A State which does not cooperate with a relevant subregional or regional fisheries management organization or arrangement shall not authorize vessels entitled to fly its flag to operate in fisheries which are subject to conservation and management measures established by that organization or arrangement.
١٤ - لا يمكن للدولة التي لا تتعاون مع منظمة دون اقليمية أو اقليمية مختصة أو ترتيب دون اقليمي أو اقليمي مختص لادارة مصائد اﻷسماك أن تأذن للسفن التي لها الحق في رفع علمها بأن تعمل في مصائد اﻷسماك الخاضعة لتدابير حفظ وادارة وضعتها تلك المنظمة أو ذلك الترتيب.

18. The requirement under article 91, paragraph 1, that there be a " genuine link " between a ship and a State that has granted its nationality to that ship is related to the right of a State, acknowledged in the same paragraph, to fix the conditions for the grant of its nationality to ships, the registration of ships in its territory and the right of ships to fly its flag.
18 - والاشتراط المنصوص عليه في الفقرة 1 من المادة 91 بوجوب أن تقوم " صلة حقيقية " بين السفينة والدولة التي منحتها جنسيتها مرتبط بحق الدولة المعترف به في الفقرة نفسها في تحديد شروط منح جنسيتها للسفن وتسجيلها في إقليمها وحقها في رفع علمها.

19. The primary obligations concerning ship safety and labour conditions assumed by the flag State as a consequence of granting its nationality and the correlative right to fly its flag to a ship in accordance with articles 91 and 92 are enshrined in article 94 of the Convention.
19 - والالتزامات الأساسية المتعلقة بسلامة السفن وشروط العمل التي تأخذها على عاتقها دولة العلم نتيجة منح جنسيتها لسفينة والحق الملازم له المتمثل في رفع علمها وفقا للمادتــين 91 و 92 من الاتفاقية مكرسة في المادة 94 منها.

Panama stated that it had designated the Maritime Authority of Panama as the authority to receive and respond to requests for assistance and for confirmation of registry or of the right of a vessel to fly its flag.
322- وذكرت بنما أنها عيّنت السلطة البحرية لبنما (Maritime Authority of Panama) كسلطة مختصة بتلقي طلبات المساعدة وطلبات تأكيد تسجيل السفينة أو حقها في رفع علمها.

(c) ensure that, where it has been established, in accordance with the laws of the flag State, that a vessel entitled to fly its flag has been involved in the commission of a serious breach of applicable conservation and management measures, that the vessel is prohibited from fishing on the high seas until such time as all outstanding criminal or civil judgments in respect of such vessel have been satisfied;
)ج( ضمان حظر قيام السفن ذات الحق في رفع علمها بالصيد في أعالي البحار حيثما يثبت، وفقا لقوانين دولة العلم، أن تلك السفينة قد ارتكبت مخالفة جسيمة لتدابير الحفظ واﻹدارة المنطبقة إلى أن يتم استيفاء جميع ما قد يكون ثمة من أحكام جنائية أو مدنية في حق تلك السفينة؛

(e) require any vessel entitled to fly its flag to give information to the investigating authority regarding catches, activities and fishing operations in the area of an alleged violation, where there are grounds for believing that the vessel has committed such a violation;
)ﻫ( مطالبة أي سفينة )سفن( ذات الحق في رفع علمها بتقديم معلومات إلى السلطة القائمة بالتحقيق عن حصائل وأنشطة وعمليات الصيد في منطقة الانتهاك المدعى وقوعه، في الحالات التي تتوفر فيها مبررات للاعتقاد بأن السفينة )السفن( قد ارتكبت مثل هذا الانتهاك.

(d) Establishment of a national record of fishing vessels incorporating information on vessels entitled to fly its flag and authorized to fish on the high seas;
)د( إنشاء سجل وطني لسفن صيد اﻷسماك يشتمل على معلومات عن السفن التي يحق لها رفع علمها والمأذون لها بالصيد في أعالي البحار؛
