The essence of the Convention against torture is that States parties are under the obligation to take legislative and administrative measures to prevent acts of torture and to declare such acts as offences under criminal law.

Articles 2 (1) and 16 (1) of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) refer to each State party's obligation to prevent acts of torture " in any territory under its jurisdiction " .

Article 2: Measures taken to prevent acts of torture
المادة 2: التدابير التي اتخذت من أجل منع أعمال التعذيب

As a matter of urgency, the State party should take immediate steps to prevent acts of torture and illtreatment of suspects in police custody and to announce a zero-tolerance policy of all acts of torture or ill-treatment by State officials or others working in their capacity.
ينبغي للدولة الطرف أن تتخذ على وجه الاستعجال خطوات فورية لمنع تعذيب وإساءة معاملة الأشخاص المحتجزين في مخافر الشرطة وأن تعلن عن سياسة عدم التسامح مطلقاً إزاء جميع أفعال التعذيب أو إساءة المعاملة التي يرتكبها موظفو الدولة أو غيرهم من العاملين بهذه الصفة.
