The shipper, on delivery of the goods to the carrier or to the performing party for carriage, is entitled to obtain from the carrier, at the shipper's option:

٤- لا يُدفع أي تعويض فيما يتعلّق بالتأخّر ما لم يوجَّه إلى الناقل في غضون واحد وعشرين يوما متتالياً من تسليم البضاعة إشعار بالخسارة الناجمة عن التأخّر.

If the seller is bound to hand the goods over to a carrier at a particular place, the risk does not pass to the buyer until the goods are handed over to the carrier at that place.
وإذا كان البائع ملزما بتسليم البضائع إلى ناقل في مكان معيّن، لا تنتقل التبعة إلى المشتري الا عند تسليم البضائع إلى الناقل في ذلك المكان.

However, if the circumstances so indicate, the risk is assumed by the buyer from the time the goods were handed over to the carrier who issued the documents embodying the contract of carriage.

Thus, article 58 (2) does not entitle the seller to let the handing over of goods to the carrier depend on advance payment of the price by the buyer, in the absence of a particular contractual provision to that effect.
وهكذا فإنّ المادّة 58(2) لا تخوّل البائع أن يقف تسليم البضائع إلى الشاحن على قيام المشتري بالدفع المسبق للثمن، بغياب حكم تعاقديّ محدّد بهذا الأثر.
