This view is often entertained because of the inclusion in article 2 of provisions that a State party is required to take action with a view to " progressively realizing " the rights enumerated there " to the maximum of its available resources " .

The phrase “to the maximum of its available resources” is intended to refer to both the resources existing within a State and those available from the international community through international cooperation and assistance.

Furthermore, the reference in article 2 to each State taking steps “to the maximum of its available resources” raises the important question of how such a “maximum” is to be determined, and by whom. Different systems of government have radically different approaches to resource allocation and management of their economies, which would make it difficult to apply a common standard.

However, the Committee, while noting that the effect of sanctions and blockades hampers the full implementation of certain rights under the Covenant, underlines that the State party remains responsible for implementing its obligations under the Covenant “to the maximum of its available resources”, in accordance with article 2, paragraph 1, of the Covenant.
