The Secretariat believed that encouraging nonsignatory States to participate in the information-gathering system of the Conference of the Parties would be a way to assist them in gaining experience on how States that were already parties to the Migrants Protocol had adjusted their legal and institutional framework in order to respond to the challenges posed by this criminal activity.
ورأت الأمانة أن تشجيع الدول غير الموقّعة على المشاركة في نظام مؤتمر الأطراف لجمع المعلومات سيوفر وسيلة لمساعدة تلك الدول على اكتساب خبرة بشأن الطريقة التي عدّلت بها الدول التي أصبحت أطرافا في بروتوكول المهاجرين إطارها القانوني والمؤسسي بغية التصدي للتحديات التي يثيرها هذا النشاط الإجرامي.

One speaker, noting that the number of States parties to the Migrants Protocol was lower than the number of States parties to the Convention or to the Trafficking in Persons Protocol, stressed the need for technical assistance activities aimed at helping States to ratify the Migrants Protocol.
56- ولاحظ أحد المتكلمين أن عدد الدول الأطراف في بروتوكول المهاجرين أقل من عدد الدول الأطراف في الاتفاقية أو بروتوكول الاتجار بالأشخاص، مشددا على الحاجة إلى أنشطة المساعدة التقنية الرامية إلى مساعدة الدول على التصديق على بروتوكول المهاجرين.

2. Technical assistance programme with regard to the Migrants Protocol

By means of an information circular dated 4 May 2006, the Secretariat reminded States parties to the Migrants Protocol of their obligation to provide information and invited signatories to do likewise at their earliest convenience, but not later than 20 May 2006.
5- وبواسطة تعميم إعلامي مؤرّخ 4 أيار/مايو 2006، ذكّرت الأمانة الدول الأطراف في بروتوكول المهاجرين بالتزامها بتقديم المعلومات، ودعت الدول الموقِّعة إلى القيام بالمثل في أبكر وقت ملائم لها، على ألاّ يتأخّر ذلك عن 20 أيار/مايو 2006.

The overview presented above demonstrates that the majority of States parties to the Migrants Protocol that responded to the questionnaire already had in place or had adopted measures to implement the provisions under consideration (art. 11-13, 16 and 18 of the Migrants Protocol).
35- تبين اللمحة الإجمالية المعروضة أعلاه أن غالبية الدول الأطراف في بروتوكول المهاجرين التي ردت على الاستبيان كانت لديها بالفعل التدابير اللازمة لتنفيذ الأحكام قيد النظر، أو اعتمدت تدابير من هذا القبيل (المواد 11-13 و16 و18 من بروتوكول المهاجرين).

The final text of the questionnaire, as approved by the Conference in accordance with its above-mentioned programme of work, was disseminated to States parties and signatories to the Migrants Protocol with a view to obtaining the required information in accordance with decision 1/6.
وعُمِّم النص النهائي للاستبيان، بالصيغة التي وافق عليها المؤتمر، وفقا لبرنامج العمل المذكور أعلاه، على الدول الأطراف في بروتوكول المهاجرين والدول الموقّعة عليه، بغية الحصول على المعلومات المطلوبة وفقا للمقرر 1/6.

The final text of the questionnaire, as approved by the Conference, was disseminated to States parties and signatories to the Migrants Protocol on 10 February 2006 with a view to obtaining the required information in accordance with decision 2/4.
وقد عُمّم نص الاستبيان النهائي، بصيغته التي وافق عليها المؤتمر، على الدول الأطراف في بروتوكول المهاجرين والدول الموقِّعة عليه، في 10 شباط/فبراير 2006، بغية الحصول على المعلومات اللازمة وفقاً للمقرّر 2/4.

Unfortunately, the rate of responses received from States parties to the Migrants Protocol during the second reporting cycle of the Conference of the Parties was lower than that for the first reporting cycle, in which the problem of underreporting had already been identified.
42- مما يدعو إلى الأسف أن معدّل الإجابات الواردة من الدول الأطراف في بروتوكول المهاجرين أثناء دورة الإبلاغ الثانية لمؤتمر الأطراف كان أدنى منه في دورة الإبلاغ الأولى، والتي حُدّدت فيها من قبلُ مشكلة نقص الإبلاغ.

The overview of the national replies presented above demonstrates that the majority of States that responded to the questionnaire and that are parties to the Migrants Protocol, already had in place or had adopted measures to implement the provisions of articles 11 to 13, 16 and 18 of the Migrants Protocol under consideration.
43- واللمحة الإجمالية عن الردود الوطنية المعروضة أعلاه تبيّن بوضوح أن أكثرية الدول التي استجابت إلى الاستبيان والتي هي أطراف في بروتوكول المهاجرين لديها من قبلُ، أو اعتمدت، التدابير اللازمة لتنفيذ أحكام المواد من 11 إلى 13 و16 و18 من بروتوكول المهاجرين التي هي قيد النظر.

(c) Requests the Secretariat to collect information from States parties and signatories to the Migrants Protocol, in the context of the above programme of work, using for that purpose a questionnaire to be developed in accordance with guidance provided by the Conference of the Parties at its first session;

As also highlighted in the questionnaire itself, the provisions of the Convention on international cooperation apply, mutatis mutandis, to the Migrants Protocol and therefore any information received from States related to international cooperation requirements under the Protocol is included in the analytical report on the implementation of the Convention (CTOC/COP/2005/2).
16- وكما بيَّن الاستبيان بوضوح، فإن أحكام الاتفاقية بشأن التعاون الدولي تنطبق - مع التعديلات التي يقتضيها الحال - على بروتوكول المهاجرين. ولهذا، فإن أي معلومات واردة من الدول، فيما يتصل بمتطلبات التعاون الدولي بموجب البروتوكول، سيشملها التقرير بشأن تنفيذ الاتفاقية (CTOC/COP/2005/2).

As also highlighted in the questionnaire itself, the provisions of the Convention on international cooperation apply, mutatis mutandis, to the Migrants Protocol and therefore any information received from States related to international cooperation requirements under the Protocol is included in the analytical report on the implementation of the Convention (CTOC/COP/2005/2/Rev.1).
