6. First, a written request for clarification must be made to the supplier or contractor concerned seeking details of constituent elements of the submission presented that the procuring entity considers relevant to justify the price submitted.
6- فأولاً، يجب توجيه طلب استيضاح كتابي إلى المورِّد أو المقاول المعني تُلتَمس فيه تفاصيل العناصر المكوّنة للعرض المقدّم التي تعتبرها الجهة المشترية ذات أهمية لتسويغ السعر المقدّم.

2. Any decision of the procuring entity to exclude a supplier or contractor from the procurement proceedings under this article and the reasons therefor shall be included in the record of the procurement proceedings and promptly communicated to the supplier or contractor concerned.
2- يُدرَجُ أيُّ قرار تتَّخذه الجهةُ المشترية باستبعاد المورِّد أو المقاول من إجراءات الاشتراء بمقتضى هذه المادة، وأسبابُ ذلك الاستبعاد، في سجل إجراءات الاشتراء، ويُسَارَع إلى إبلاغه إلى المورِّد أو المقاول المعني.

Such rejection of the tender, proposal, offer or quotation and the reasons therefor shall be recorded in the record of the procurement proceedings and promptly communicated to the supplier or contractor.
ويسجل مثل هذا الرفض للعطاء أو الاقتراح أو العرض أو عرض اﻷسعار وأسباب رفضه في سجل إجراءات الاشتراء ويبلغ على الفور إلى المورد أو المقاول.

The notice is dispatched when it is properly addressed or otherwise directed and transmitted to the supplier or contractor, or conveyed to an appropriate authority for transmission to the supplier or contractor, by a mode authorized by article 9.

123- اتَّفقت اللجنة على أن تضيف الفقرة الجديدة 3 التالية: " حينما يكون قد أُجري تقييم للعطاءات الأولية، تُشفع كل دعوة إلى المناقصة أيضا بنتيجة التقييم فيما يخص المورِّد أو المقاول الذي تُوجَّه إليه الدعوة. "

3. A tender received by the procuring entity after the deadline for presenting tenders shall not be opened and shall be returned unopened to the supplier or contractor that presented it.
3- لا يُفتَح أيُّ عطاء تتسلّمه الجهة المشترية بعد الموعد النهائي لتقديم العطاءات، بل يُعاد من دون فتحه إلى المورّد أو المقاول الذي قدّمه.

6. The provisions of the article are without prejudice to any other sanctions, such as debarment (see paragraphs ... above), that may be applied to the supplier or contractor.
6- ولا تنطوي أحكام المادة على أيِّ مساس بأيِّ عقوبات أخرى مثل فرض الحظر (انظر الفقرات ... أعلاه) قد تطبق على المورِّد أو المقاول.

(3) The procurement contract shall be awarded to the supplier or contractor that gave the lowest-priced quotation meeting the needs of the procuring entity.
)٣( يرسى عقد الاشتراء على المورد أو المقاول الذي قدم أدنى عرض أسعار يفي باحتياجات الجهة المشترية.

(c) The procuring entity shall, on request, provide to the supplier or contractor a receipt showing the date and time when its tender was received.
)ج( تقدم الجهة المشترية للمورد أو المقاول بناء على طلب ايصالا يبين فيه التاريخ والوقت اللذين ورد فيهما عطاؤه.
