284. The Committee is deeply concerned by the high number of extrajudicial and summary executions, disappearances, cases of torture, ill-treatment, and arbitrary arrest and detention by members of the army and security forces and by the failure of the Government to investigate fully these cases, to prosecute alleged offences, to punish those found guilty and provide compensation to the victims or their families.
٢٨٤ - وشعرت اللجنة بقلق بالغ إزاء ارتفاع عدد حالات اﻹعدام الخارجة عن القانون وحالات اﻹعدام بدون محاكمة وحالات الاختفاء والتعذيب وسوء المعاملة وإلقاء القبض والاحتجاز التعسفي التي يقوم بها أفراد القوات المسلحة وقوات اﻷمن وعدم اتخاذ الحكومة أي إجراءات بصددها وعدم إجراء أي تحقيقات متعمقة بشأنها حتى تتم محاكمة مرتكبيها ومعاقبتهم كما لم تمنح أي تعويضات للمجني عليهم أو أسرهم.

He notes with regret from the Government's replies that cases have been closed under the amnesty law, and reiterates the obligation of Governments to investigate alleged violations of the right to life thoroughly and impartially, to identify those responsible and bring them to justice, and to provide appropriate compensation to the victims or their families.

He reiterates his call to the Transitional Government of Ethiopia to ensure that all allegations of human rights violations are exhaustively and impartially investigated, with a view to establishing the facts, identifying those responsible and bringing them to justice, granting adequate compensation to the victims or their families, and preventing the recurrence of such violations.

The right to due process has not been properly respected, since the competent bodies have failed to carry out the State's duty to investigate, prosecute and punish perpetrators of human rights violations and, where appropriate, to award due compensation to the victims or their families.
١٨٢ - ولم يحترم على النحو المناسب الحق في سلامة اﻹجراءات القانونية إذ أن الهيئات المختصة لم تؤد واجب الدولة في التحقيق، وفي مقاضاة ومعاقبة مقترفي انتهاكات حقوق اﻹنسان وتقديم التعويض المناسب عند الاقتضاء للضحايا أو ﻷسرهم.

404. The Special Rapporteur also calls on all Governments to conduct exhaustive and impartial investigations into all cases of alleged extrajudicial, summary or arbitrary executions, identify those responsible and bring them to justice, grant adequate compensation to the victims or their families, and take the necessary steps to prevent further violations, in conformity with their obligation under international law.

States have an obligation to conduct exhaustive and impartial investigations into allegations of violations of the right to life, to identify and bring to justice the perpetrators, to grant adequate compensation to the victims or their families and to take effective measures to avoid the recurrence of such violations.

Such a fund could be allocated for the payment of at least some compensation to the victims or their families and would undoubtedly enhance faith in the work of the Tribunals and people's willingness to cooperate with them.
