Nevertheless, the Committee is concerned that the provisions of the Criminal Code do not include all purposes and forms of the sale of children included in article 3, paragraph 1, of the Optional Protocol, notably the transfer of organs of the child for profit.

Article 3, paragraph 1 (a), of the Optional Protocol requires that States criminalize the sale of children, in particular, the offering, delivering or accepting of a child for the purpose of sexual exploitation, transfer of organs or the engagement of a child in forced labour, and improperly inducing consent for the illegal adoption of a child.

The Optional Protocol calls on States parties to prohibit the sale of children, child prostitution and child pornography and to criminalize in their national legislation as a minimum, inter alia, the offering, delivering or accepting of children for purposes of sexual exploitation, transfer of organs for profit or engagement in forced labour.

The Kuwaiti legislature imposes strict rules on the transfer of organs, creating tough laws to deal with anyone who transfers human organs from a deceased person without obtaining prior consent from that person while he or she was alive, or from his or her relatives after the death. This is intended to increase protection for human rights.
ونلاحظ تشدد المشرع الكويتي في سياق نقل الأعضاء حيث وضع قانون صارم تجاه كل من تسول لـه نفسه نقل أعضاء الإنسان في حال مماته دون إذن مسبق من الشخص المتوفى حال حياته أو من أقربائه بعد ممات المتبرع وذلك لإضافة حماية أكبر على حقوق الإنسان.

41. The Committee is concerned that in light of recent cases of offering, delivering or accepting of a child for the transfer of organs for profit and that this crime is not prohibited and criminalized, in accordance with article 3, paragraph 1, of the Optional Protocol.
41- ويساور اللجنة القلق لأنه على ضوء الحالات التي جرت مؤخراً فيما يتعلق بعرض الأطفال أو تسليمهم أو قبولهم لأغراض نقل الأعضاء تحقيقاً للربح،فإن هذه الجريمة لا تُحظر ولا تُجرّم، وفق ما تقتضيه الفقرة 1 من المادة 3 من البروتوكول الاختياري.

44. CRC recommended that Yemen criminalize the sale of children for the purpose of transfer of organs for profit, and bring perpetrators to justice.
44- وأوصت لجنة حقوق الطفل بأن يُجرّم اليمن بيع الأطفال لغرض نقل الأعضاء من أجل الربح وبتسليم الجناة إلى العدالة(104).

Every person who traffics in organs for transplanting shall be liable to a term of imprisonment at hard labour and a fine of LS 50,000 to LS 100,000. (Decree regulating the transfer of organs).

Although there are no laws on this subject, the draft amendments to the Code of Offences and Penalties which have been approved by the Cabinet and submitted to the House of Representatives for consideration and adoption do contain provisions designed to prevent the transfer of organs for profit (see paragraph 21 above).

(d) There is no provision criminalizing transfer of organs of the child for profit.

Article 3, subparagraph 1 (a) (i), of the Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography (General Assembly resolution 54/263, annex II), requires the criminalization of offering, delivering or accepting, by whatever means, a child for the purpose of transfer of organs of the child for profit.
19- وتقضي الفقرة الفرعية 1 (أ) `1` من المادة 3 من البروتوكول الاختياري الملحق باتفاقية حقوق الطفل بشأن بيع الأطفال واستغلالهم في البغاء وفي المواد الإباحية (المرفق الثاني من قرار الجمعية العامة 54/263)، بتجريم عرض أو تسليم أو قبول طفل بأي وسيلة كانت لغرض نقل أعضائه توخّيا للربح.

(a) The sale of children by offering, delivering or accepting, by whatever means, a child for the purpose of sexual exploitation, transfer of organs of the child for profit, or engagement of the child in forced labour or improperly inducing consent, as an intermediary, for the adoption of a child in violation of the applicable legal instrument on adoption;
(أ) بيع الأطفال عن طريق عرض أي طفل أو تسليمه أو قبوله، بأية وسيلة كانت لغرض الاستغلال الجنسي، أو نقل أعضائه لغرض الربح، أو إشراكه في عمل قسري، أو العمل كوسيط للحصول بطرق غير سليمة على الموافقة على تبني طفل، انتهاكاً للصك القانوني المنطبق على التبني؛

(a) The sale of children by offering, delivering or accepting, by whatever means, a child for the purpose of sexual exploitation, transfer of organs of the child for profit, or engagement of the child in forced labour or improperly inducing consent, as an intermediary, for the adoption of a child in violation of the applicable legal instrument on adoption;

The Optional Protocol on the Sale of Children, Child Prostitution and Child Pornography, supplementing the Convention on the Rights of the Child, requires States parties to ensure that the sale and sexual exploitation of children, transfer of organs, engagement in forced labour, and child pornography are fully covered by criminal law.
ويقتضي البروتوكول الاختياري بشأن بيع الأطفال، واستغلال الأطفال في البغاء وفي المواد الإباحية، المكمّل لاتفاقية حقوق الطفل من الدول الأطراف كفالة أن يشمل القانون الجنائي على نحو كامل بيع الأطفال واستغلالهم الجنسي، ونقل أعضاء الأطفال، وإشراكهم في العمل القسري، واستغلال الأطفال في المواد الإباحية.

(b) To thoroughly review the draft modern slavery bill to ensure that it includes all the types of crime defined in articles 2 and 3 of the Optional Protocol, such as forced labour, transfer of organs of a child for profit, adoption of a child for profit and the sale of children, and addresses the particular vulnerabilities and needs of child victims.
(ب) إجراء استعراض شامل لمشروع القانون المتعلق بالرق المعاصر للتأكد من تضمنه جميع أنواع الجرائم المعرفة في المادتين 2 و3 من البروتوكول الاختياري، مثل العمل الجبري ونقل أعضاء الأطفال لتحقيق ربح وتبني الطفل توخياً للربح وبيع الأطفال، وتصديه لأوجه الضعف والاحتياجات الخاصة للأطفال الضحايا.

Although the Act focuses on the removal of organs and tissue from a deceased person, it does refer to the transfer of organs from a living person. Under the Act, the transplant can only be carried out as a gift, under the conditions laid down in the law.
وبالرغم من أن القانون يركز على نزع الأعضاء والأنسجة من الشخص المتوفي إلا أنه أفرد نصوصاً لنقل الأعضاء من الشخص الحي، وعلى حسب نص القانون فإن النقل لا يتم إلا بالهبة بشروطها المعروفة في فقه القانون.
