وأضاف أنه يؤيد قرار اللجنة في دورتها الحادية والأربعين عدم إدراج أحكام خاصة بشأن التحكيم التعاهدي ضمن قواعد التحكيم والتعامل مع هذا الأمر فقط بعد الانتهاء من عملية التنقيح الحالية؛ وربما تكون هناك موضوعات أخرى تحتاج أيضا لأن ينظر فيها الفريق العامل في تلك المرحلة.

The prevailing view, in line with the decision previously made by the Commission, was that it was too early to make a decision on the precise form and scope of a future instrument on treaty-based arbitration and that the mandate of the Working Group should be limited to the preparation of rules of uniform law on transparency in treaty-based investor-State arbitration.

After in-depth consideration of the above issues, the Working Group reached the following conclusions. (a) It was generally recognized that arbitration proceedings in treaty-based arbitration raised issues that, in some respect, differed from ordinary commercial arbitration and a large number of delegations expressed the view that they required, on certain points, distinct regulation.
69- بعد مناقشة معمّقة للمسائل المذكورة أعلاه، خلص الفريق العامل إلى الاستنتاجات التالية: (أ) سُلِّم عموما بأن إجراءات التحكيم في التحكيم التعاهدي تثير مسائل تختلف في بعض النواحي عن التحكيم التجاري العادي، وأعرب عدد كبير من الوفود عن رأي مفاده أن تلك الإجراءات تتطلب، في نقاط معيّنة، تنظيما مميزا.

In planning the future activities of the Working Group, the Commission may wish to recall the conclusions reached at its forty-first session, in 2008, and forty-second session, in 2009, that the topic of transparency in investor-State treaty-based arbitration was worthy of future consideration and should be dealt with as a matter of priority immediately after completion of the current revision of the UNCITRAL Arbitration Rules.
7- ولدى التخطيط لأنشطة الفريق العامل المقبلة، لعل اللجنة تود أن تستذكر ما خلصت إليه في دورتها الحادية والأربعين، عام 2008، ودورتها الثانية والأربعين، عام 2009، من استنتاجات بأن موضوع الشفافية في التحكيم التعاهدي بين المستثمرين والدول جدير بأن يُنظر فيه مستقبلا وينبغي تناوله كمسألة ذات أولوية فور الانتهاء من التنقيح الجاري لقواعد الأونسيترال للتحكيم.

After discussion, the Commission agreed that it would not be desirable to include specific provisions on treaty-based arbitration in the UNCITRAL Arbitration Rules themselves and that any work on investor-State disputes which the Working Group might have to undertake in the future should not delay the completion of the revision of the UNCITRAL Arbitration Rules in their generic form.
وبعد المناقشة، اتفقت اللجنة على أن من غير المستصوب إدراج أحكام محدّدة بشأن التحكيم استنادا إلى المعاهدات في قواعد الأونسيترال للتحكيم نفسها وعلى أن أي عمل بشأن النـزاعات بين المستثمرين والدول قد يضطر الفريق العامل إلى الاضطلاع به في المستقبل لا ينبغي أن يؤخّر إنجاز تنقيح قواعد الأونسيترال للتحكيم في شكلها العام.

314- وبعد المناقشة، اتفقت اللجنة على أن من غير المستصوب إدراج أحكام محدّدة بشأن التحكيم استنادا إلى المعاهدات في قواعد الأونسيترال للتحكيم نفسها وعلى أن أي عمل بشأن النـزاعات بين المستثمرين والدول قد يضطر الفريق العامل إلى الاضطلاع به في المستقبل لا ينبغي أن يؤخّر إنجاز تنقيح قواعد الأونسيترال للتحكيم في شكلها العام.

For that reason, the Commission's decision not to include specific provisions on treaty-based arbitration in the Rules was welcome.
ولهذا السبب يعتبر موضع الترحيب قرار اللجنة بأن لا تدرج في تلك القواعد أحكاما معينة بشأن التحكيم المستند إلى المعاهدة.
