260- واستناداً إلى ما سبق بيانه، فإنّ الدولة التونسية تضمن الحق في تأسيس منظمات أو جمعيات تعنى بموضوع الاختفاء القسري وتشريكها في وضع البرامج والسياسات والتشريعات الهادفة إلى الوقاية من هذه الظاهرة ومعالجة أسبابها.

6.1 In its observations of 11 December 2008, the State party, referring to recent information on human rights violations in Tunisia, notes that, according to these sources, Tunisian State repression is particularly directed at political opponents, human rights defenders and terrorist suspects.
6-1 في ملاحظاتها المؤرخّة 11 كانون الأول/ديسمبر 2008، تلاحظ الدولة الطرف، في معرض إشارتها إلى معلومات حديثة عن انتهاكات حقوق الإنسان في تونس، أنه، وفقاً لتلك المصادر، يُوجَّه القمع من جانب الدولة التونسية على وجه الخصوص ضدّ المعارضين السياسيين والمدافعين عن حقوق الإنسان والمشتبه بهم أنهم إرهابيون.

It defines places of detention as " all places that are or could come under the jurisdiction and control of the Tunisian State or that were established with its agreement and in which there could be persons deprived of their liberty by order of a public authority or at its instigation or with its consent or acquiescence " .
كما يُعرّف أماكن الاحتجاز بكونها " كلّ الأماكن التي تخضع أو يمكن أن تخضع لولاية الدولة التونسية وسيطرتها أو التي أقيمت بموافقتها والتي يمكن أن يوجد فيها أشخاص محرومون من حريتهم بموجب أمر صادر عن سلطة عمومية أو بإيعاز منها أو بموافقتها أو سكوتها " .
