On appeal Mr. Umarov's sentence was reduced from ten and a half years to seven years and eight months and Ms. Khidoyatova's was reduced to a seven-year suspended sentence with a three-year probationary period and her immediate release in return for financial compensation to the State.
وخفضت في المرحلة الاستئنافية عقوبة السجن الصادرة ضد السيد عمروف من عشر سنوات ونصف إلى سبع سنوات وثمانية أشهر وخفضت عقوبة السجن الصادرة ضد السيدة خيدوياتوفا إلى سبع سنوات مع وقف التنفيذ مع وضعها تحت المراقبة لمدة ثلاث سنوات وإطلاق سراحها فورا مقابل دفع تعويض مالي للدولة.

2.6 On the same day and while still in the building, Mr. Umarov's lawyer filed an official petition requesting a medical examination by court order and to be notified of the results of the examination, since he suspected that psychotropic drugs had been forcibly administered to his client.
2-6 وفي اليوم نفسه، قدّم محامي السيد عمروف أثناء وجوده في المبنى، التماساً رسمياً يطلب فيه إجراء فحص طبي بأمر من المحكمة وإخطاره بنتائج الفحص، إذ كان يشك في إعطاء موكّله قسراً لمؤثرات عقلية.

On 28 October 2005, Mr. Umarov's lawyer filed a complaint with the Head of the Tashkent Department of Internal Affairs demanding a response in writing to his request for a judicial psychiatric evaluation of his client.
وفي 28 تشرين الأول/أكتوبر 2005، رفع محامي السيد عمروف شكوى إلى رئيس إدارة الشؤون الداخلية لطشقند يطلب فيها رداً خطياً على طلبه إجراء تقييم قضائي نفساني لحالة موكّله.

On 15 November 2005, Mr. Umarov's lawyer filed a petition to require the investigators to conduct a " standard medical evaluation of the overall health " of the author's husband.
وفي 15 تشرين الثاني/نوفمبر 2005، قدّم محامي السيد عمروف التماساً يطلب فيه من المحققين إجراء " تقييم طبي عادي للحالة الصحية العامة " لزوج صاحبة البلاغ.

The letter also stated that, as far as the Prosecutor's Office was concerned, it was only from 2 November that Mr. Umarov's lawyer was officially acting on his behalf, following an authorization issued by his wife and son.
وبيّنت الرسالة أيضاً أنه بالنسبة للنيابة العامة، فإن محامي السيد عمروف لم يكن يتصرف رسمياً باسمه إلا من تاريخ 2 تشرين الثاني/نوفمبر عندما صدر إذن بذلك من زوجته وابنه.

2.11 On 9 November 2005, Mr. Umarov's lawyer filed a statement with the General Prosecutor of the Republic, challenging and refuting the statements made in this letter.
2-11 وفي 9 تشرين الثاني/نوفمبر 2005، قدّم محامي السيد عمروف بياناً إلى المدعي العام للجمهورية يدحض ما ورد في تلك الرسالة ويطعن فيه.

3.1 On the issue of exhaustion of domestic remedies, the author submits that numerous attempts have been made to remedy the above-mentioned violations, including petitions and complaints made by Mr. Umarov's lawyers.
3-1 فيما يتعلق بمسألة استنفاد سبل الانتصاف المحلية، تدعي صاحبة البلاغ أن محاولات متعددة قد جرت لتدارك الانتهاكات المذكورة أعلاه، بما في ذلك التماسات وشكاوى قدّمها محامو السيد عمروف.

5.3 On 19 April 2006, Mr. Umarov's lawyer again requested in writing to be allowed to visit him and to receive information about his state of health, since neither he, nor Mr. Umarov's family, had been allowed a visit since 28 March 2006.

The State party also submits that Mr. Umarov will be allowed to meet with his lawyers if he personally files a written request to the administration of the colony, in accordance with article 10 of the Criminal Correctional Code of Uzbekistan and that the rights of convicts, including Mr. Umarov's, are ensured in accordance with the existing legislation.
وتقول الدولة الطرف أيضاً إنه سيُسمح للسيد عمروف بمقابلة محاميه إن تقدّم هو شخصياً بطلب خطي لإدارة المرفق، طبقاً للمادة 10 من قانون الإصلاح الجنائي لأوزبكستان، وتقول إن حقوق المدانين، بمن فيهم السيد عمروف، مكفولة وفقاً للتشريعات السارية.

Accordingly, the Committee considered that the arrest, trial and conviction of Mr. Umarov resulted in effectively preventing him from expressing his political views and found that the State party had violated Mr. Umarov's rights under article 19, paragraph 2, and article 26 of the Covenant.
وبناء عليه، رأت اللجنة أن اعتقال السيد عمروف ومحاكمته وإدانته أدى إلى منعه بالفعل من التعبير عن آرائه السياسية، وخلصت إلى أن الدولة الطرف انتهكت حقوق السيد عمروف بموجب الفقرة 2 من المادة 19 والمادة 26 من العهد.
