وقد استندت هذه التهمة الموجهة للسيدة يويمانا إلى مقالتين نُشرتا في صحيفة يومورابيو.

21. The second article appeared in issue No. 29 of Umurabyo.

Until then they were reportedly told that their arrest was based on newspaper articles that had appeared in Umurabyo, and the Rwanda genocide law was cited.
وتفيد المعلومات بأنهما قبل إبلاغهما بالتهم الموجهة إليهما أُبلغتا بأن اعتقالهما نجم عن المقالات الصحفية التي نُشرت في صحيفة يومورابيو وذُكر قانون الإبادة الجماعية الرواندي.

19. The first article on which the defamation charge was based was published in issue No. 23 of Umurabyo.
19- وكانت المقالة الأولى التي وُجهت تهمة التشهير على أساسها قد نُشرت في العدد 23 من صحيفة يومورابيو.

The Court noted that Ms. Mukakibibi knew that her article, published in Umurabyo, would be widely read by many Rwandans.
وأشارت المحكمة إلى أن السيدة موكاكيبيبي كانت تدرك أن مقالتها المنشورة في صحيفة يومورابيو سيقرأها عدد كبير من الروانديين.

Moreover, the statement clearly does not amount to genocide denial when considered in the context of the article as a whole, in which Ms. Uwimana criticized ethnic divisions in the country, and in the context of her other articles, including an article in issue No. 23 of Umurabyo.
كما أن البيان لا يصل، وبصورة واضحة، إلى حد إنكار الإبادة الجماعية إذا نُظر إليه في سياق المقالة ككل، التي انتقدت فيها السيدة يويمانا الانقسامات العرقية في البلد، وكذلك في سياق مقالاتها الأخرى، بما فيها مقالة نُشرت في العدد 23 من صحيفة يومورابيو.

The same issue of Umurabyo contained an article entitled " The war between Kagame's regime and the population " .
ونُشرت أيضاً في العدد نفسه من صحيفة يومورابيو مقالة بعنوان " الحرب بين نظام كاغامي والسكان " .

The charge was based on an article published by Ms. Mukakibibi entitled " King Kigeli is the solution to national unity and reconciliation " , which appeared in issue No. 29 of Umurabyo.
واستندت التهمة إلى مقالة للسيدة موكاكيبيبي بعنوان " الملك كيغلي هو الحل للوحدة الوطنية والمصالحة " نشرتها في العدد 29 من صحيفة يومورابيو.

Prior to the ongoing period of detention, Ms. Uwimana had been arrested on 12 January 2007 for publishing in Umurabyo an anonymous letter allegedly written by a former member of President Paul Kagame's party, the Rwandan Patriotic Front (RPF).
وقبل فترة الاحتجاز الحالية، اعتُقلت السيدة يويمانا في 12 كانون الثاني/يناير 2007 لنشرها في صحيفة يومورابيو رسالة مجهولة المصدر يُدعى أن كاتبها عضو سابق في الجبهة الوطنية الرواندية، وهي حزب الرئيس بول كاغامي.

The charge was based on the following statement made by Ms. Uwimana in issue No. 21 of Umurabyo: " Rwandans lived for a long time with this hatred until they ended up killing each other after [former President] Kinani [Habyarimana]'s death. "
واستندت التهمة إلى البيان التالي الذي كتبته السيدة يويمانا في العدد 21 من صحيفة يومورابيو: " عاش الروانديون زمناً طويلاً بهذه الكراهية إلى أن آل بهم الأمر إلى قتل بعضهم لبعض بعد وفاة [الرئيس السابق] كيناني [هابياريمانا] " ().

The Court further noted that Ms. Uwimana knew that the article would reach many citizens, as Umurabyo was a bi-weekly publication " distributed everywhere " .
وأشارت المحكمة أيضاً إلى أن السيدة يويمانا كانت تدرك أن المقالة ستصل إلى عدد كبير من المواطنين، لأن صحيفة يومورابيو تصدر مرتين أسبوعياً ولأنها " توزع في كل مكان " ().

61. Moreover, in the present case, the Working Group has examined paragraphs 68 through 75 of the judgment rendered by the Supreme Court of Rwanda in April 2012, where it considered the defamation conviction based on Ms. Uwimana's statement in the article published in issue No. 23 of Umurabyo.
61- علاوة على ذلك، قام الفريق العامل في إطار هذه القضية بدراسة الفقرات من 68 إلى 75 من الحكم الذي أصدرته محكمة النقض الرواندية في نيسان/أبريل 2012، حيث نظرت في إدانة السيدة يويمانا بتهمة التشهير استناداً إلى بيانها في المقالة المنشورة في العدد 23 من صحيفة يومورابيو.
