وفي الفقرة الرابعة من الديباجة يرحّب مشروع القرار بما ورد في الإعلان الختامي للمؤتمر الاستعراضي الرابع من إعادة التأكيد على أن استخدام الأسلحة البكتريولوجية (البيولوجية) والسُمية واستحداثها وإنتاجها وتكديسها خاضع للحظر الفعلي في جميع الأحوال بموجب المادة الأولى من الاتفاقية.

وترحب الفقرة الرابعة من الديباجة بالتأكيد مجددا في الإعلان الختامي للمؤتمر الاستعراضي الرابع على الحظر الفعلي في جميع الأحوال، استخدام الأسلحة البكتريولوجية (البيولوجية) والسُمية واستحداثها وإنتاجها وتكديسها بموجب المادة الأولى من الاتفاقية.

The Court further held that the Respondent had violated its obligation under article VI of the Genocide Convention to cooperate fully with the International Criminal Tribunal for the Former Yugoslavia with respect to the arrest and handing over for trial of General Mladić, and thus violated its obligation to punish genocide under article I of the Convention.
وخلصت المحكمة كذلك إلى أن المدعى عليها خرقت واجبها بموجب المادة السادسة من اتفاقية الإبادة الجماعية ولم تتعاون كلية مع المحكمة الجنائية الدولية ليوغوسلافيا السابقة فيما يتعلق بإلقاء القبض على الجنرال ملاديتش وتسليمه بقصد محاكمته، فخرقت واجبها بالمعاقبة على الإبادة الجماعية بموجب المادة الأولى من الاتفاقية.

وعلى غرار السنوات السابقة، سترحب الجمعية من خلال مشروع القرار بما ورد في الإعلان الختامي للمؤتمر الاستعراضي الرابع من إعادة تأكيد للحظر الفعلي في جميع الأحوال لاستخدام الأسلحة البكترولوجية (البيولوجية) والتكسينية واستحداثها وإنتاجها وتكديسها، وذلك بموجب المادة الأولى من الاتفاقية.
