By way of explanation, it was pointed out that this provision was intended to provide comfort to intermediate holders such as banks that, as long as they did not exercise any right under the contract of carriage, they would not assume any liability under that contract.
وعلى سبيل التفسير، أشير إلى أن القصد من هذا الحكم هو التيسير على الحائزين المباشرين، كالمصارف مثلا، بأنهم ماداموا لا يمارسون أي حق بمقتضى عقد النقل، فهم لن يتحملوا أي مسؤولية بمقتضى ذلك العقد.

3. For the purposes of paragraphs 1 and 2 of this article, a holder that is not the shipper does not exercise any right under the contract of carriage solely because:
٣ - لأغراض الفقرتين 1 و 2 من هذا المادة، لا يمارس الحائز الذي ليس هو الشاحن أي حق بمقتضى عقد النقل لمجرد أنه:

(a) The time of receipt of the goods is subsequent to the beginning of their initial loading under the contract of carriage; or
(أ) أن يكون وقت تسلُّم البضاعة لاحقا لبدء تحميلها الأولي بمقتضى عقد النقل؛ أو

(b) The time of delivery of the goods is prior to the completion of their final unloading under the contract of carriage.
(ب) أن يكون وقت تسليم البضاعة سابقا لإتمام تفريغها النهائي بمقتضى عقد النقل.

(b) With respect to any amounts payable to the carrier under the contract of carriage, except to the extent that the carrier has adequate security for the payment of such amounts.
(ب) فيما يتعلق بأي مبالغ واجبة السداد إلى الناقل بمقتضى عقد النقل، طالما كانت لدى الناقل ضمانة كافية لسداد تلك المبالغ.

1. Without prejudice to article 57, a holder that is not the shipper and that does not exercise any right under the contract of carriage does not assume any liability under the contract of carriage solely by reason of being a holder.
