1. For the purposes of this Convention the expression " forced or compulsory labour " shall mean all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily.
١ - في مصطلح هذه الاتفاقية، تعني عبارة " عمل السخرة أو العمل القسري " جميع اﻷعمال أو الخدمات التي تفرض عنوة على أي شخص تحت التهديد بأي عقاب، والتي لا يكون هذا الشخص قد تطوع بأدائها بمحض اختياره.

(f) The exaction of any work or service from any child under the menace of a penalty.
(و) إكراه الطفل على أيّ عمل أو خدمة تحت التهديد بالعقوبة.

Article 2, paragraph 1, of that Convention defines " forced labour or services " as: " All work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily. "
فالفقرة 1 من المادة 2 من هذه الاتفاقية تعرِّف " الأعمال أو الخدمات القسرية " بأنها: " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوّع هذا الشخص لأدائها بمحض اختياره " .

It is to be recalled that both acts provided " for the exaction of labour and services, including porterage service, under the menace of a penalty from residents who have not offered themselves voluntarily " .
ويجب اﻹشارة إلى أن القانونين كليهما ينصان " على فرض تقديم العمل والخدمات، بما في ذلك خدمة العتالة، تحت التهديد بالعقاب، على السكان الذين لا يقدمونها بصورة طوعية " .

International Labour Organization (ILO) Convention (No. 29) concerning Forced Labour defines " forced or compulsory labour " as all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily (art. 2).
أما الاتفاقية رقم ٩٢ الصادرة عن منظمة العمل الدولية والمتعلقة بالعمل الجبري، فإنها تقصد بتعبير " العمل الجبري أو الالزامي " كل أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص ﻷدائها بمحض اختياره )المادة ٢(.

163. According to ILO Convention No. 29 concerning forced labour the term " forced or compulsory labour " shall mean all work or service exacted from any person under the menace of any penalty and for which said person has not offered himself voluntarily.
٣٦١ - تعني عبارة " عمل السخرة أو العمل القسري " بمقتضى اتفاقية منظمة العمل الدولية رقم ٩٢ الخاصة بالسخرة جميع اﻷعمال أو الخدمات التي تفرض عنوة على أي شخص تحت التهديد بأي عقاب، والتي لا يكون هذا الشخص قد تطوع بأدائها بمحض اختياره.

9- وتعرِّف منظمة العمل الدولية العمل الجبري على أنه " كل أعمال أو خدمات تُطلب عنوةً من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص لأدائها بمحض اختياره " ().

31- يُعرّف العمل القسري بأنه " كل أعمال أو خدمات تُغتصب من أي شخص تحت التهديد بأية عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " ().

The Convention defines forced or compulsory labour as " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " , and provides certain limited exclusions.
وتحدد الاتفاقية العمل القسري أو السخرة على أنه " جميع الأعمال أو الخدمات التي يُجبر عليها أي شخص تحت التهديد بأي عقوبة والتي لم يعرض من أجلها الشخص المذكور بنفسه القيام بها طوعا " ، كما تنص على بعض الاستثناءات المحدودة.

When the work is exacted (including through deception or false promises on the type of work, and confiscation of passports) from a person under the menace of a penalty (such as the threat of deportation for leaving one's employer), this can amount to forced labour and in some cases servitude.
وعندما يُطلب من أي شخص العمل عنوة (بطرق منها الخداع أو تقديم وعود كاذبة بشأن نوع العمل، ومصادرة جوازات السفر) تحت التهديد بالعقوبة (مثل التهديد بالترحيل عند ترك صاحب العمل)، يمكن أن يعد ذلك سخرةً بل قد يرقى إلى اعتباره، في بعض الحالات، عبودية.

In ILO Convention (No. 29) Concerning Forced or Compulsory Labour, forced labour was defined as " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
وفي اتفاقية منظمة العمل الدولية (رقم 29) المتعلقة بالعمل الجبري أو الإلزامي عرفت السخرة بأنها " كل أعمال أو خدمات تُغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " .

3.1 The author refers to article 2, paragraph 1, of ILO Convention No. 29 (1930) concerning Forced or Compulsory Labour which defines forced or compulsory labour to mean " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
3-1 يشير صاحب البلاغ إلى الفقرة 1 من المادة 2 من اتفاقية منظمة العمل الدولية رقم 29(1930) المتعلقة بالعمل الجبري، التي يُقصد فيها بتعبير العمل الجبري أو الإلزامي " أي أعمال أو خدمات تغتصب من أي شخص تحت التهديد بأي عقوبة ولم يتطوع هذا الشخص بأدائها بمحض اختياره " .

However, in the case of children or adolescents who because of their age are unable to give their valid consent, prostitution is taken by ILO supervisory bodies to be forced labour within the meaning of the Forced Labour Convention, 1930 (No. 29) which refers to " all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily " .
ومع ذلك فإنه في حالة اﻷطفال أو اليافعين الذين لا يستطيعون، بحكم سنهم، اﻹعراب بشكل مقبول عن رضاهم، تعتبر اﻷجهزة اﻹشرافية لمنظمة العمل الدولية الدعارة كعمل جبري بالمعنى الوارد في الاتفاقية )رقم ٩٢( بشأن العمل الجبري الذي يعني جميع اﻷعمال أو الخدمات التي تفرض عنوة على أي شخص تحت التهديد بأي عقاب والتي لا يكون هذا الشخص قد تطوع بأدائها بمحض اختياره.
