2 Expenditure on direct underlying losses in excess of the direct funding requirement

The claim relates to interest on underlying losses which the Panel has found are not compensable.

The Panel also finds that KAC acted reasonably in pursuing the Insurance Proceedings against the KAC Insurers, not only because KAC was ultimately successful in such proceedings but also because at such time there was no assurance that KAC would be entitled to an award from the Commission or from another source in relation to the underlying losses.

The Panel finds that those adjustments reflect the panels’ assessment that the underlying losses suffered were in some manner overvalued by claimants.

The sum of the amount of compensation awarded for the underlying losses and for the direct financing losses as set out in the preceding paragraph will, in the Panel’s consideration, give the best measure of compensation for the losses sustained, as set out in paragraph 136 above.

The Panel notes that the underlying losses are in fact losses of an asset (i.e. cash), and relevant direct financing losses arise because the cash not received needs to be replaced from another source.

Kuwait further argued that most of the underlying losses relate to the loss of, or damage to, real and tangible property, and that such losses occurred when the property in question was lost or damaged (i.e. at points between 2 August 1990 and liberation).
298- وذكرت الكويت أيضاً أن معظم الخسائر الأصلية تتعلق بفقدان ممتلكات عقارية أو ممتلكات ملموسة أو إصابتها بضرر، وأن هذه الخسائر حدثت عندما فُقدت الممتلكات المعنية أو لحق بها ضرر (أي ما بين 2 آب/أغسطس 1990 والتحرير).

The Panel considers that the effect of this provision is to make compensable claims for payments made or relief provided by Governments in respect of losses for which the recipient would have been otherwise entitled to file a claim before the Commission, to the extent that the underlying losses are compensable in accordance with the criteria developed by the Commission.

The Panel finds that, as described in paragraphs 48-93 above, the underlying losses of KAC's aircraft spares, engines and ground equipment are compensable as direct losses resulting from Iraq's invasion and occupation of Kuwait.
155- ويرى الفريق أن الخسائر الأساسية المتصلة بقطع غيار طائرات شركة الخطوط الجوية الكويتية ومحركاتها ومعداتها الأرضية هي خسائر تستوجب التعويض بوصفها خسائر مباشرة ناجمة عن غزو العراق واحتلاله للكويت، على نحو ما ورد في الفقرات 48-93 أعلاه.
