1. 1 - لا يعتبر اتخاذ الدول الأطراف تدابير خاصة مؤقتة تستهدف التعجيل بالمساواة الفعلية بين الرجل والمرأة تمييزا بالمعنى الذي تأخذ به هذه الاتفاقية. ولكنه يجب ألا يستتبع، على أي نحو، الإبقاء على معايير غير متكافئة أو منفصلة. كما يجب وقف العمل بهذه التدابير متى تحققت أهداف التكافؤ في الفرص والمعاملة.

The granting of affirmative action measures may not as a consequence lead to the maintenance of unequal or separate standards and they shall be discontinued after the objectives for which they have been taken have been achieved.
ومن ثم، لا يجوز أن يؤدي منح تدابير العمل الإيجابي إلى الإبقاء على معايير غير متكافئة أو منفصلة ويتعين وقف هذه التدابير بغية تحقيق الأهداف التي اتُخذت من أجلها(55).

32- إن اعتماد تدابير خاصة مؤقتة من أجل الوصول إلى تحقيق مساواة فعلية بين الرجل والمرأة وللمجموعات المحرومة ليس انتهاكاً للحق في عدم التمييز بالنسبة للتعليم، كما أن هذه التدابير لا تؤدي إلى الإبقاء على معايير غير متكافئة أو منفصلة للمجموعات المختلفة، بشرط ألا تستمر بعد بلوغ الأهداف التي اتخذت من أجلها.

The Committee also reiterates the need to ensure that the special measures adopted in no case lead to the maintenance of unequal or separate rights for different ethnic groups after the objectives for which they were taken have been achieved.
وتكرر اللجنة الحاجة إلى ضمان ألا تؤدي التدابير الخاصة المعتمدة في أي حالة من الحالات إلى الإبقاء على حقوق غير متساوية أو منفصلة لمختلف المجموعات الإثنية بعد تحقيق الأهداف التي وُضعت من أجلها.

The Committee encourages the State party to engage in a datagathering exercise to ensure that special measures are designed and implemented for all beneficiary communities on the basis of their prior consultation and active participation, and that they will not result in the maintenance of unequal or separate rights for those groups after the objectives for which they were taken have been achieved.
تشجع اللجنة الدولة الطرف على جمع البيانات على نحو يضمن تصميم وتنفيذ التدابير الخاصة لجميع المجتمعات المستفيدة على أساس التشاور معها مسبقاً ومشاركتها مشاركة نشطة، ويضمن ألا تؤدي تلك التدابير إلى الإبقاء على حقوق غير متساوية أو منفصلة لهذه المجتمعات بعد تحقيق الأهداف التي وُضعت من أجلها.

These measures shall in no case entail as a consequence the maintenance of unequal or separate rights for different racial groups after the objectives for which they were taken have been achieved " (article 2, para. 2).
ولا يجوز في أية حال أن يترتب على هذه التدابير، كنتيجة لذلك، إدامة أية حقوق متفاوتة أو مستقلة تختلف باختلاف الجماعات العرقية بعد بلوغ اﻷهداف التي اتخذت من أجلها " )المادة ٢، الفقرة ٢(.
