After examining the Working Group's report, the Commission had adopted a set of 10 Guiding Principles applicable to unilateral declarations of States which were capable of creating legal obligations and it had commended the Guiding Principles to the attention of the General Assembly.
وبعد دراسة تقرير الفريق العامل، اعتمدت اللجنة مجموعة من 10 مبادئ توجيهية تنطبق على الإعلانات الانفرادية للدول التي بمقدورها إنشاء التزامات قانونية وامتدحت المبادئ التوجيهية وأوصت بها لعناية الجمعية العامة.

As indicated by principle 10 of the Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations, adopted in 2006 by the International Law Commission:

1. Delegations commended the Commission, the Special Rapporteur and the Working Group for the adoption of the " Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations " .

15. Turning to the topic of unilateral acts of States, he said that the Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations were, despite the many years of work devoted to the topic, descriptive rather than prescriptive.
15 - وتطرّق إلى موضوع التصرفات الانفرادية للدول فقال إن المبادئ التوجيهية المنطبقة على الإعلانات الانفرادية للدول يمكن أن ترتبّ التزامات قانونية برغم السنوات الطويلة من الأعمال التي كُرّست لهذا الموضوع وبرغم أن هذه المبادئ وصفية أكثر من كونها توجيهية.

15. Ms. Goldsmith (Australia) commended the work done by the Commission to develop Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations.
15 - السيدة غولدسميث (أستراليا): أثنت على الأعمال التي أنجزتها اللجنة من أجل وضع المبادئ التوجيهية المنطبقة على الإعلانات الانفرادية للدول بما يتيح نشوء التزامات قانونية.

(4) It was in this spirit that the Commission elaborated principle No. 7 of the Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations:

That principle was reflected in the guiding principles applicable to unilateral declarations of States capable of creating legal obligations adopted by the Commission in 2006, pursuant to which a unilateral declaration entailed obligations for the formulating State and could not generate obligations incumbent on other States without their consent.

(2) Since reservations are unilateral acts, the Commission based itself on the guidelines for interpreting such acts contained in the Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations, which it adopted in 2006.

3. Takes note of the Guiding Principles applicable to unilateral declarations of States capable of creating legal obligations under the topic " Unilateral acts of States " , contained in paragraph 176 of the report of the International Law Commission1 and commends their dissemination;
3 - تحيط علما بالمبادئ التوجيهية المنطبقة على الإعلانات الانفرادية للدول التي يمكن أن تنشئ التزامات قانونية في إطار موضوع ' ' الأعمال الانفرادية للدول``، والواردة في الفقرة 176 من تقرير لجنة القانون الدولي(1)، وتشيد بنشر تلك المبادئ؛

Her delegation therefore believed that the Commission should finish its work on that topic, with the adoption of the Guiding Principles applicable to unilateral declarations of States capable of creating objections, which essentially stressed that States could undertake legal obligations through unilateral declarations whose binding character was based on the fundamental legal principle of good faith.
