(1) This guideline addresses the specific problems that can arise with respect to the territorial scope of reservations considered as being maintained following a uniting of two or more States.

While this provision establishes a general presumption in favour of the maintenance of reservations, there are nonetheless exceptions to this presumption in certain cases involving the uniting of two or more States; these are dealt with in draft guideline 5.3, to which reference is made in draft guideline 5.2, paragraph 1.

According to the provision, when, following a uniting of two or more States, a treaty in force at the date of the succession of States in respect of any of them continued in force in respect of the successor State, only the reservations formulated by the State that was a party to the treaty were considered to be maintained.
