27. In connection with working paper A/AC.105/C.2/L.192, the representative of ITU briefly described the legislative and treaty-making role of ITU with regard to the use of the geostationary orbit.

Other delegations reiterated the view that ITU was the appropriate body to address questions concerning the use of the geostationary orbit and was addressing those questions effectively.

The view was expressed that outer space should be viewed as the province of all humankind, that all States should be able to benefit from its use and, in that context, that the rational and equitable use of the geostationary orbit should be ensured for all States.
75- ورُئي أنه ينبغي أن يُنظر إلى الفضاء الخارجي على أنه إقليم تابع للبشرية قاطبةً وينبغي أن يتسنى للدول كافة الاستفادة من استخدامه وأن يُكفل لجميع الدول، في ذلك السياق، استخدام المدار الثابت بالنسبة للأرض استخداما رشيدا وعادلا.

Some delegations expressed the view that close communication should be maintained among the Scientific and Technical Subcommittee, the Legal Subcommittee and other relevant bodies of the United Nations system, with the aim of promoting the development of binding international rules that addressed the use of the geostationary orbit.
219- وأعربت بعض الوفود عن رأي مفاده أنه ينبغي الحفاظ على علاقات التواصل الوثيقة بين اللجنة الفرعية العلمية والتقنية واللجنة الفرعية القانونية وسائر هيئات منظومة الأمم المتحدة ذات الصلة، بهدف العمل على وضع قواعد دولية ملزمة تتناول استخدام المدار الثابت بالنسبة للأرض.

Some delegations expressed the view that the Subcommittee should cooperate with ITU in all possible aspects of outer space activities, including with respect to avoiding an abuse of the use of the geostationary orbit by some States and international organizations and coordinating the application of international treaties.
85- وأعرب بعض الوفود عن رأي مفاده أنه ينبغي للجنة الفرعية أن تتعاون مع الاتحاد الدولي للاتصالات في جميع الجوانب المتعلقة بأنشطة الفضاء الخارجي، بما في ذلك فيما يتعلق بتجنّب إساءة استخدام المدار الثابت بالنسبة للأرض من جانب بعض الدول والمنظمات الدولية، وتنسيق تطبيق المعاهدات الدولية.

Those delegations therefore considered that the item on the geostationary orbit should remain on the agenda of the Subcommittee for further discussion through working groups, intergovernmental panels or task forces, for the purpose of continuing to analyse the scientific and technical characteristics of the orbit and in order to ensure the use of the geostationary orbit in accordance with international law.
لذا رأت تلك الوفود أنَّ البند المتعلق بالمدار الثابت بالنسبة للأرض ينبغي أن يظلّ مدرجاً في جدول أعمال اللجنة الفرعية لإجراء مزيد من المناقشات بشأنه، في إطار أفرقة عاملة أو أفرقة حكومية دولية أو فرق عمل، بغرض مواصلة تحليل خصائص هذا المدار العلمية والتقنية ولضمان استخدام المدار الثابت بالنسبة للأرض وفقاً للقانون الدولي.

Some delegations expressed the view that the current Constitution, Convention and Radio Regulations of ITU, as well as the current procedures set out in the treaties on international cooperation among countries and groups of countries with respect to the geostationary orbit and other orbits, fully took into account the interest of States in the use of the geostationary orbit and the radio frequency spectrum.
77- وأعرب بعض الوفود عن رأي مفاده أن الدستور الحالي للاتحاد الدولي للاتصالات واتفاقيته ولوائح الراديو التي أصدرها، وكذلك الإجراءات الراهنة المبيّنة في المعاهدات المتعلقة بالتعاون الدولي بين البلدان ومجموعات البلدان فيما يتعلق بالمدار الثابت بالنسبة للأرض وسائر المدارات، تراعي تماما مصالح الدول في استخدام المدار الثابت بالنسبة للأرض وطيف الترددات الراديوية.

His delegation noted the constructive attitude of the Colombian delegation in preparing a revised version of the draft principles for the use of the geostationary orbit, which would take account of the proposals that had been submitted, in time for the following session.
ولاحظ وفده الموقف البناء لوفد كولومبيا في إعداد نص منقح لمشروع المبادئ المتعلقة باستخدام المدار الثابت بالنسبة لﻷرض يراعي المقترحات المقدمة وذلك في وقت يسمح بعرضه على الدورة القادمة.

In the view of that delegation, the questions concerning the use of the geostationary orbit should be addressed in the context of the 1967 Outer Space Treaty, and the Legal Subcommittee should exercise extreme caution in its work so as not to affect adversely the role of ITU.
وفي رأي ذلك الوفد، ينبغي طرق المسائل المتعلقة باستخدام المدار الثابت بالنسبة لﻷرض في سياق معاهدة الفضاء الخارجي لعام ١٩٦٧، وينبغي أن تلتزم اللجنة الفرعية القانونية الحذر الشديد في أعمالها بحيث لا تؤثر بصورة سلبية على دور الاتحاد.

There was an objective need to restart dialogue on various topics concerning equitable and effective use of the geostationary orbit, including the work of the International Telecommunication Union in that field.
فثمة حاجة موضوعية لاستئناف الحوار عن مختلف المواضيع المتصلة باستخدام المدار الثابت بالنسبة لﻷرض على نحو منصف وفعال، بما فيها العمل الذي يضطلع به في هذا المجال الاتحاد الدولي للاتصالات السلكية واللاسلكية.

32. Some delegations expressed the view that both the Committee on the Peaceful Uses of Outer Space and its Legal Subcommittee had a mandate to consider questions relating to the use of the geostationary orbit with a view to elaborating general legal principles on this question.
٣٢ - وأعربت بعض الوفود عن الرأي بأن لكل من لجنة استخدام الفضاء الخارجي في اﻷغراض السلمية ولجنتها الفرعية القانونية ولاية للنظر في المسائل المتصلة باستخدام المدار الثابت بالنسبة لﻷرض بهدف إعداد مبادئ قانونية عما بشأن هذه المسألة.

The Committee had agreed with the Subcommittee that the Secretariat, in cooperation with the secretariat of the International Telecommunication Union (ITU), should provide, for the 1997 session of the Subcommittee, an analysis of the compatibility of the approach contained in the working paper with the existing rules and procedures of ITU relating to the use of the geostationary orbit.

Some delegations expressed the view that the working paper submitted by Colombia (A/AC.105/C.2/L.200 and Corr.1) provided a sound basis for achieving a solution related to the use of the geostationary orbit and that the Legal Subcommittee should continue its consideration of the item.
٦٣ - وأعربت بضعة وفود عن رأي مفاده أن ورقة العمل التي قدمتها كولومبيا A/AC.105/C.2/L.200) و (Corr.1 توفر أساسا سليما للتوصل الى حل يتعلق باستخدام المدار الثابت بالنسبة لﻷرض وأنه ينبغي للجنة الفرعية القانونية أن تواصل النظر في هذا البند .

Some delegations expressed the view that this item should remain on the agenda of the Subcommittee and that its study could be carried out, as necessary, by working groups or intergovernmental panels in order to ensure the use of the geostationary orbit in accordance with international law.
232- ورأت بعض الوفود أنَّ هذا البند ينبغي أن يظلّ مدرجا في جدول أعمال اللجنة الفرعية، وأنَّ دراسته يمكن أن تجري، حسب الاقتضاء، في إطار أفرقة عاملة أو حلقات نقاش حكومية دولية، ضماناً لاستخدام المدار الثابت بالنسبة للأرض وفقاً للقانون الدولي.

They believed that there was a need to establish a sui generis legal regime for regulating access to and the use of the geostationary orbit, which was a limited natural resource.
وأعربوا عن اعتقادهم بأن ثمة حاجة الى انشاء نظام قانوني خاص به بذاته لتنظيم سبل الوصول الى المدار الثابت بالنسبة لﻷرض واستخدامه ، علما بأنه مورد طبيعي محدود .
