Article 165. In other countries, crimes against women are not prosecuted or suspects can easily be exonerated of penal liability, for example when a rapist marries, or offers to marry, the victim (in some extreme cases even when the victim is a minor).

It has also been made clear that, if the victim of the enforced disappearance is a minor, the Criminal Code calls for a more severe penalty: " The upper half of the penalties provided for in the preceding articles [which relate to unlawful detention and abduction] shall be imposed in the corresponding cases if [...] the victim is a minor [...] " (art. 165).
255- وقد وُضح أن القانون الجنائي يدعو إلى تطبيق عقوبة مشددة إذا كان ضحية الاختفاء القسري قاصراً: " النصف الأشد من العقوبات المنصوص عليها في المواد السابقة [التي تتعلق بالاختفاء والاحتجاز غير القانوني] يُطبق في الحالات المقابلة إذا كان [...] الضحية قاصراً [...] " (المادة 165).

However, if the victim is a minor under 14 years old, the penalty is of 5 to 15 years of imprisonment; in case of a minor between 14 and 18 years old, the penalty of 2 to 8 years of imprisonment is increased by one third in its minimum and maximum limits.
بيد أنه إذا كان المجني عليه قاصراً لم يبلغ الرابعة عشر من عمره فإن العقوبة تكون هي الحبس لمدة تتراوح بين 5 سنوات و15 سنة؛ وفي حالة القاصر الذي يتراوح عمره بين 14 و18 سنة فإن عقوبة الحبس التي تتراوح بين سنتين و8 سنوات تزداد بمقدار الثلث في حديها الأدنى والأقصى.

The above penalties shall be applicable where the offence is committed without deception or violence if the victim is a minor under 15 years of age.
تُفرض العقوبات السابقة إذا ارتُكب الفعل دون خداع أو عنف على قاصر لم يتم الخامسة عشرة من عمره.
