The authors argue that a recurrence of a violation of the provisions of the Covenant during the general elections of 2010 while the authors' communication was still under consideration by the Committee cannot invalidate the procedure which results from the previous violation during the 2005 general elections, even though domestic remedies are available to dispute the recurring violation.

The Committee also notes that the author does not contest the State party's submission that any flaw in the imposition of the sentence of life imprisonment was rescinded by the author's early release from prison, and finds that the author also failed to substantiate a violation of the provisions of the Covenant in that regard.
وتلاحظ اللجنة أيضاً أن صاحب البلاغ لم يعترض على ما ورد في ملاحظات الدولة الطرف من أن أي عيب في الحكم بعقوبة السجن المؤبد على صاحب البلاغ قد تم تصحيحه بالإفراج المبكر عنه، وترى أن صاحب البلاغ لم يقدم كذلك أدلة تثبت وقوع انتهاك لأحكام العهد في هذا الصدد.

Also the obligation to provide effective remedy for any violation of the provisions of the Covenant is considered unable to be set aside even though not listed under article 4.
كما أن واجب توفير سبل انتصاف فعالة من أي انتهاك لأحكام العهد لا يمكن أن يوضع جانبا حتى وإن لم يُدرج في المادة 4 من العهد([12]).

In its general comment No. 29 on states of emergency (article 4 of the Covenant), the Human Rights Committee stated that " article 2, paragraph 3, of the Covenant requires a State party to the Covenant to provide remedies for any violation of the provisions of the Covenant.
